I won a phony "voluntary quit" charge many years ago. I was fighting against a sweetheart deal made in secret by my BA. Had a target on my back, lost in arbitration, no surprise there - my BA smiled and said "tough break kid" - but I hired a labor attorney and went to court and won. My attorney also threatened my local with a duty-of fair-representation lawsuit when they initially refused to cooperate. When a company doesn't have a legitimate reason for a dismissal they try to pull "voluntary quit" crap. Can't let the company or the Union get away with it.
We had one guy on outbound that left two hours early last week. Fmla. He told the super when ie got done loading a trailer he was gonna leave sick. He did just that and came back to work the next day. Nothing said... Nothing done to him.
But.. He told a super. Didn't have someone do it for him.
Unreal the extent they will go to fire someone. If only he would have just told him he was leaving. Common sense.
