Thought we didn't use the 34 hour restart? After 2 days off my log book shows 25 hours ,my computer shows 70 available. Just got a letter saying the computer is what they are going by. Anyone have any thoughts on this??
 
Well, you have until 2/1/17 to get it resolved. They were aware of the agreement with the union to not use the 34hr reset, but have not reprogrammed the ELDs to reflect that yet. My guess is they won't, and the union will just roll over. Someone said this is an old software program they are running, that's why it is more complicated than it really needs to be. Who knows......? They told us it would only add 2-3 mins per trip. It actually adds 2-3 mins every time you log a stop IF everything goes right. But I freely admit I am a computer dummy. Others may be having better luck. I asked them if we could soon quit calling ourselves in and out on the phone unless we needed driver instructions, and they didn't think so. They now know within 100 feet of where we are at any given moment in time, what our equipment numbers are, and our manifest #. Calling in and out just seems redundant to me. I really liked the freedom and mutual trust we had as road drivers to just go and do our jobs and stay out of the ditch and not wrinkle their sheet metal or otherwise embarrass them, and they would send us a check every week. That philosophy built this industry and attracted the best drivers over the decades. Now they control us as tightly as a city p&d driver. What a shame...

Again, the ELD is what it is. It runs according to DOT, the law, not ABF or union rules/ agreements, or programs regarding 34 hr restart. the rules we have in place are still in effect, we don't operate under the 34 hr restart technically because we pretty much restart under our operating procedures. its not needed. I doubt 1 driver, the 34 hr restart would ever apply to here at ABF..
 
So will someone enlighten me as to how it will NOT be falsification of logs after 2/1/17 to certify that my ELD recap is accurate when in fact it is NOT if I have had a DOT 34 hr reset if I present it to a weighmaster or cop on demand? I'm sure I am missing something here.....WAIT! I HAVE IT! Just blame it on the Russians hacking into the system! Just keep a straight face and not glance at his handcuffs.....

I am retired & old fashioned. And I get around on a computer pretty good. But I still print my receipts even though I get an e-mail showing I paid my light bill. And then I back up my document files (my briefcase) once a week & a full image back up for my machine once a month. Some people think that is over kill. Maybe. But the first time you lose all your important files, pictures, e-mail, software, & cannot recover them, you will wish you had. Then comes the fun part. You get to enter in to therapy. You can call it BA for Backup Anonymous.
 
iam4us, did you read my latest post? We will need to keep 2 recaps. The Law Dogs don't care about our work rules. It's already happening to drivers who are taking 48hrs and 8s off according to what they tell me.

Keeping track of your hrs would not be the same has running two logs or falsifying your log....
 
Am I over-thinking this? If you show a law-enforcement officer your e-log recap on hrs of service availability when he requests it in a roadside inspection, and he questions you as to it's accuracy, what do you say? If it shows, as shrink wrap says in his initial post that started this thread, that he has 70 hrs available according to DOT regs, but he actually can only use 25 hrs because of our work rules, is that not a technical falsification of hours-of -service availability? It doesn't really matter if it is less or more , it.s not accurate. The 24 hr logs will be accurate, but the recap could be off becuz of our work rules.When we ran our paper logs, we recapped according to work rules and no one was the wiser. It seems to me that when I certify my e-logs as being accurate, as we are now required to do each day, I want to be certain that they ALL are.Or do we qualify that by stating that available hours of service could be inaccurate subject to work rules in effect? Good luck with that.

34 hour restart is voluntary as far as the FMCSA see's it. You do not have to do a restart.
The NMFA company's have agreed to not do a 34 hour restart with the Teamsters.
Just make sure you have your card to tell them how to get information off your machine and you must be able to operate it for them.
No card and not being able to work machine seem to be what they like to write the ticket for.
I have noticed as of late the DOT have been more interested in the GVW and what weight the combination is plated for.

Thanks Cab Lizzard. This is starting to sink into my thick skull a little. But you have opened up a WHOLE bunch of wormcans now! What card and how DO you pull it off the ELD? And maybe even more importantly, if this 34hr restart is voluntary, and I think I remember now you are correct, why does ABF not reprogram the ELDs to show that option instead of make us run a separate recap to stay in compliance with the work rules after 2/1/17 when the paper logs go away except for payroll?
 
Should be option on screen where you can decline your 34 and roll off your recap. I know Qualcomm offered it.
I don't think people net has that option from what I understand. Being a computer you would think that they could program it to do what they want it to do though....

When I was pulled over in Richmond, Ga for a roadside inspection once, the D.O.T man asked to see my log. He only looked at my log for a few seconds and gave it back. When I made a comment about how quick that was, his reply was "I' only checked to see if you were off for 34 hrs, had enough hrs to work, and we're up to date". I then made a comment about ABF not using the 34 hr restart and his reply was, " That doesn't matter to me. Once I see you've been off for 34 hrs and/or have enough hrs to work if you haven't been off for the restart, you're legal under the law. It doesn't matter what rules you're company has". So based on this encounter I really don't think we will have a problem. Also according to a friend in Carlisle, the company will keep track of your hrs by entering the hrs worked off of the ELD into the company computer the same way they're doing it now with the paper logs. I will make sure I also keep track though so they don't tell me I have more hrs than I do....

One would think Ft ::shit:: would have one in every power unit.
Its the drivers responsibility to be able to produce and operate the E-Log machine as it is also your name on the ticket.

I was just given a card to put in the truck Monday. Its a laminated sheet of paper that has instructions on how to get to the roadside inspection part of the eld.
