Holland | Going over 60 today

This is my first full year at Holland as a city driver and would like some feedback. Due to the end of quarter business I had to work saturday, so today I will have over 60 hos in the last 7 days. I recently learned Holland doesn't recognize the 34 hour reset. Today, should I punch out when I hit 60 or complete my 8. This being said, my terminal has a 10 hr minimum. So many rules it seems like a write-up is coming no matter what. Any thoughts as to how your terminal handles this situation is appreciated.

If you run on a 60 hours in 7 day period, you will be violating hours of service once you pass 60 hours today. So you are saying you have been getting 12 plus hours per day since last weds? With just Sunday off? Do yourself a huge favor and get off the road before running out of hours, because if you get into any kind of an accident, your fault or not, you will be toast.
 
you cannot be written up for obeying the law. I would punch out at 60. It is the teamsters who do not recognize the 34 hr. restart. The company cannot force a 34 hr. restart. This was put into place to allow junior men an opportunity to work. this was before sub standard wages and working environment made it impossible to hire quality employees. So currently the company wants to work you like a borrowed mule because of their mismanagement however don't be bullied into putting you and your family in jeopardy. It is up to you and only you to obey the law. the company will not pay your fine etc, if you were to have an accident it is your a$$ as management won't even remember your name.

you have to at least work 8, if not 10. that being said you DO NOT have to be driving to accomplish this, if you are out of hrs dont drive. inform them you are low on hours and if they hang you out too long i would tell them "if i do this stop im going to go over my hrs" so theyll bring you back..if they send you there and you dont have enough time to make it back on time even if there is rush hour trfc you call them and get yourself towed in or have them send a driver. if they send you somewhere and it takes awhile, inform them of the delay and if they need to tow you in so be it..theyll hang you out to dry in a heartbeat, i got a letter of encouragement for supposedly going over my 60 by ".21" hrs with a total of 60.35 when i punched out..let them eat that 1k tow bill and maybe they will put you on the dock rather than risking it. there are a number of guys at my terminal who have been towed in multiple times, tell them OUT OF HOURS. its not your problem from there, they need to either send a driver or a tow truck. i would make sure you are in a safe spot before you run out of hours though, you might be sitting there for 2-3 hrs.

Maybe I'm missing something but Saturday would be on last weeks check.

What time did you clock out Saturday and what time did you clock in on Monday?

You are not in violation of law if you had 34 hours off duty. DOT could care less about company policy or union policy.
 
Awhile back I was running towards the end of my shift at New Penn and got a message on the computer to call the operations manager when I called he told me I had a hour left and if I couldn't make it in due to traffic or whatever not to put myself in jepordy to pull over and call that they would come and bring me in. I appreciated him doing that.
Times have changed now they seem to push guys to go over and not care.

Was this bumping 14th hour or on Friday?
 
If you punched out on Saturday at like 6pm and didn't punch in till Monday at 6am you are totally fine. You have your 34 restart. If you don't want to work follow Holland/Union rules. If you want to work follow the dot federal law. You won't get in trouble for following the federal law.

depending on if your terminal is enforcing company rules/union rules you might get in trouble up to and including discharge. no 34 hr restart, 7 day recap.

If you are at terminal you can stay on dock and not be in violation, non driving work.
 
Don't drive over 60 hrs , and refuse to work the dock after 100 hrs , as that's what they want to work everybody anymore !

If you are working the dock, stay & work. Then file on it later. If you are going to the street tell them when you hit 60. Then they can make the decision of you working. DO IT WITH A WITNESS. CYA. You only violate DOT Regulations when you drive a CMV on a public street & go over you 60 in 7 or 70 in 8. You can work 24/7 on the dock & not be in violation. You have to get below your 60 or 70 rule to be able to drive. 34 hour reset? Check with your business agent or Steward. Be very sure of this before refusing work. Good luck. von.

Your 30 minute lunch counts against your 14 hour clock. If you enter a lunch in some kind of PDA or computer, make sure you take it by the start of your 8th hour from coming on duty. If you don't take it by then you are in violation of the DOT rules & you can be fired or given a letter. DO NOT give them a reason to come after you. If you work only 8 hours & take no lunch you are legal. If you take a lunch, be sure to start it by the 8th hour. von.

Your lunch time counts against your on duty hours,even though you are not paid for it?
 
Thanks to everyone for the input. Things worked out well after all. When I started work on 4-5 I let dispatch know I WOULD be back in the yard before my 60 was up! They gave me a quick volume load and a couple of pickups. At my last pickup I called in and was given a couple emergency pickups. I clearly let them know I could only get one of them as I was out of hours. They never removed the last pickup and proceeded to call my two-way and cell phone. but I was driving and couldn't answer. I arrived back in time. I am certain dispatch was mad but it was never brought to my attention. I did have to complete my 10 hours on the dock due to freight volume.
On another note, the emergency pickups were a couple hours past actual close time. What a rookie mistake on their part
