With Omnitracs all city drivers come in on Monday with 60 hours available. Just a couple months ago my terminal was giving write ups for going over 60 in any 7 day period. Does our ELD nullify the terms of our contract?

If you work Monday-Friday as a city driver, you will always have 60 available on Monday, as long as you didn't work on the weekends...you pick up zeros for Saturday and Sunday,

I thought we weren't suppose to use the 34 hour restart. Union rule.
Your not. If you work over 12 hours a day you can run out of hours in a 5 day work week. YRC and ABF do not use 34 hour reset. The DOT doesn’t go by our contract so they can’t ticket us is all.
 
ELD are a BIG joke and don't work right and our barn said the Union don't allow a 34 reset ? It seems nobody knows what is correct ?

I do. There is no 34 hour reset per the contract. Company and union enforces this per union contract. The DOT does not enforce union contracts so you will not receive a ticket by the DOT for using iT. The union on the other hand can grieve any use of the 34 hour restart and impose fines on the company per union agreement. If that happens the company sends letters out to the drivers for not following the contract. They inforce it at ABF. Who knows what they let YRC companies get away with.
 
If the contract book wasn't an inch thick and loaded with a bunch of lawyer speak, there wouldn't be so much confusion either.

There is a memo sent out to all NMFA companies and locals that the union honor the 34 hour reset when I find it I will post.
 
Yep. But other opinions will day just the opposite.
There are companies who try to make up their own rules and get their own exemptions to fit their needs. They just hope to not get caught and get challenged on the issue. It should be set in stone.

It is. It’s just people don’t like a rule so they ignore it. I’ve been with YRC, Holland, and ABF in the past 10 years. The 34 hour union agreement was posted at all 3 places. People just ignore rules they don’t like.
