I heard a guy was injured he wrecked a side-by-side off duty. got beat up pretty bad then turn around and claimed workman's comp injury for a pinched nerve. been off work for quite a while turns around they finally find out what the problem is. he's got two crushed vertebrae in his neck has to have surgery mean while he claims that he pinched a nerve by picking up a gear.how do you crush two vertebrae in your neck by lifting a gear? FedEx was told about it and nothing seems to happen that's just a lot of money being paid out for someone that lied I don't get it.

It is all in the details. And, the smart people won't talk about their medical condition except for a priest, lawyer, or doctor. You tell someone about your medical problems, other than those I mentioned, you might also include a letter to your employer. Makes it an easier decision to get rid of you, I mean a expensive cost to them.
 
Agreed, it’s all in the wording. We’ve had guys who were injured on the job (actually on the yard, on the clock) and were denied workman’s comp because of the way they worded their claim.
Doesn’t make sense to me either...

Based on the past are all the injured using a lawyer if they are serious injuries? von.
 
RC wasn’t seriously injured, but there was no disputing it. Very clear video of the whole thing.
Still never been shown this or any similar video. Seems it would be of great educational value to communicate the risk and keep safety "top of mind".

Perhaps legal says no" Or perhaps no one considered it... :idunno:
 
truckingBORED is friends with a lawyer who represents the company. truckingBORED is glad he doesn't get hurt on the job. truckingBORED thinks if the company doesn't beat the employee a high percentage of the time, FedEx finds a different law firm that can... truckingBORED thinks FedEx plays to win. truckingBORED is fine with that. :)
 
All they would have to do is investigate. Almost every one in the terminal knows it was a b.s. call. 1st they were told off duty injury. Then 3weeks later it was a on duty claim. Like I said before how do you crush two vertebrae in your neck picking up a gear. haven't heard much else on the matter. But sure am surprised that legal like this fly. Think about how much money this guy got away with. After wages med bills surgery rehab. I bet it's easily 75000 plus.
 
There is no shortage of workers comp fraud. There is also no shortage of people that got prosecuted after the fact that now have lots of time to think about why they shouldn’t have done it now that they’re Bubba’s bitch.
 
Haven’t lost any time yet, but will for an injury from Oct 2015. Already have lifetime medical stipulated by the courts, WTF do I need an ambulance chaser for?
