I am seeking a copy of the COO that took place on November 2017 that created UTILITY workers at several terminals; I believe the conditions are being regularly violated but need to read the language to verify;
I also have questions concerning the limits of seniority; can a senior "brother" bump me off the toilet? Just how far can seniority push a man?
 
QUESTION #1 (not having a true copy of the above requested COO):
Scenario; there are three Utility bid starts of 5pm, 6pm, 7pm; these bids are posted as accepted (and enforced?);
the 5pm takes a sick day and a casual (laid off) is called in and accepts to fill the 5pm bid;
the 6pm bid, having seniority over the casual, exercises his "seniority" over the casual and bumps him off the 5pm start and onto the 6pm start;
the 7pm start then exercises his "seniority" and bumps the now 6pm casual to the 7pm start;
my question is: if a man has chosen and accepted to perform a bid, is he locked into that bid until the next posting for bid changes?
 
QUESTION #2 (not having a true copy of the above requested COO):

With the COO referenced above my Terminal did receive 3 Utility positions, i believe these positions are SET IN STONE to last 6 months, thereafter the Utility positions will dovetail into the regular Terminal job bidding process;

we have 2 new men, and one of our men (couldn't find 3 foreign takers) take these Utility positions;

IF the 2 new men were subject to leaving their terminal, joining my Terminal under the condition that they are required to serve the Utility position for 6 months before dovetailing; IS the man from my terminal subject to the same dovetail conditions?;

I believe the man from my Terminal LEFT my Terminal and then joined my Terminal as Utility and is subject to the same 6 month obligation before dovetail as the 2 new men

starting tomorrow, the man from my terminal has been permitted to dovetail into the regular job bidding process thereby forcing all others to be subject to the Utility bid;

did/does the COO allow such action?

[NOTE, my Terminal has allowed violation of NMFA for many years, our TM has actively performed Checker duties for years, and many other violations because the senior "brothers" aren't directly effected and therefore turn a blind eye...

all reasoned information, thoughts, remedy are appreciated...

is Easter Sunday a paid or unpaid or not considered at all a Holiday (i am southern)? It is not listed as such in my copy of NMFA April 1, 2008 through March 31, 2013.
i am working on my ARTICLE 55 notice for next week and only wish to speak out of the "mouth" of NMFA.
[it's peculiar how Christmas Eve and New Years Eve are listed but Easter isn't]

They put the Easter holiday on the Friday after thanksgiving
 
The Central States Supplement has 10 paid holidays.
New Years Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day, the Friday after Thanksgiving, Christmas Eve, Christmas Day, Anniversary (date of hire) Day and Birthday.

Western States has, in addition, two ‘personal,’ floating holidays that were negotiated by forfeiting Veterans Day and MLK, but I may be mistaken.

They are up to something. We all know that. But it's not for our benefit and we will be the last to know.
As for a coo in June. I have no idea.
In my opinion. Which means nothing.
I don't see any of this coming out in the favor of employees
Gotta keep the morale in the toilet.
We all know what needs to be done. But none of it will.

I consider what they have done to our terminal a coo.
Seeing how they pretty well shut down Dallas we send everything to Oklahoma city Memphis. San Antonio. And several other breakbulks. All of it. The only thing we send to Dallas is their own city freight.
That's a change of operations.

Obviously 1: you are in different rules than any I ever saw, and 2: I’ve been gone for 10 years. But (everywhere I ever was), if a guy was officially awarded a 5pm at bid time, someone else was officially awarded a 6pm at bid time, and a third guy was officially awarded a 7 pm at bid time- those are their bid starts until next official bid times, be it 6 months until they are posted, or next week when they are officially posted. They can be offered early starts on OT, but they can’t just change their bids because someone is off, and replaced by a laid-off man. If the laid off man accepted 5pm, he starts at 5. Now-..... IF there is not enough work to hit the street, he Might be held until later on the dock, and then the Senior UE guy might Leave first, but the 5pm timestart is his, and his OT starts at the end of the normal 5pm shift, or he can go home at the normal end of the 5pm shift. There’s no jumping over from 6pm bids or 7 pm bids to 5 once he accepted the call- at least in the Indy Area where I worked... the 6 Bids and 7 pm bid guys can start early on OT and do the same work as the 5pm laid off guy- but their shift doesn’t end until its normal time...
