We have a new supposed rule that you have to take your 30 minute lunch break no matter how many hours you work in day even if you are no where near 12 and sometimes less than 8. But the deal is you can call dispatch and tell them your not able to take lunch and it's ok. Had a few drivers question it, so I thought I'd see if other terminals were like that. We’ve had our ELD’s in our tractors for a year and a half. Rule is: A 30-minute break at or before 8 hours.
 
Ya we have had ours for quite some time, just some drivers that weren't able to take lunch started catching grief around January. It's supposedly mandatory but if u call in they will allow you to keep rolling.
 
was always told as long as you don’t work over 12 don’t have to take it as a city driver using short haul provisions haven’t taken one in a long time
But obviously if you run linehaul have to take it before your 8
 
Hey Kenneth can you tell me what goes on at your term you and some of the others have great inout.
We are told to take lunch.Most of the time I do.But,if I'm getting off early I may not take one or maybe just 15 minutes.But,by federal law local runs under short haul exemption.So you only have to show 30 mins if you work over 12 hours .I think it's more of a term deal.
 
I would love to see the company mandate a lunch time ,say start time +5 or 6 hours.
In California we're "supposed" to have completed lunch before the 6th hour.Not the DOT rule of before 8.However leaving with a route so late.Its tough to do sometimes.Try to hammer down push all the freight off and then take lunch whenever.If they start to enforce it again I will just have to go another way.

Its all terminal and region decisions, "rules" will vary greatly. There is a region that the lunch is not taken out and you do not have to take one. And regions that the lunch is taken out automatically so you may as well take at least a small lunch to stop the 30 min clock.
 
I don't know anything about P&D and "short haul" regs. I do know that you don't have to take a 30 minute break if you will not be driving again when your 8 hour window is up. So, a driver could start his daily 14 clock, drive up until his first 8 hours, go from driving to on-duty, and work the dock for the rest of the 14 hour day without having to take a mandatory 30 minute break.

the rule is from dot you must take a 30 min break or you will be in violation of dot regulations

Strange, we have to do it between 6 and 8 hours. But I’m line so it’s maybe different. I know that we get wrote up if we do it 1 minute after the 8th hour.
