Trucking company scrambles to raise cash to avoid bankruptcy
YRC Worldwide finalized an agreement with its largest pension fund to defer pension contributions as the trucking company scrambles to raise cash to avoid bankruptcy.
Central States, Southeast and Southwest Areas Pension Fund agreed to allow YRC to use the company’s real estate as collateral in lieu of making $83 million in pension payments to the pension fund. The agreement calls for the company to repay the deferred contributions over three years beginning in January 2010.

YRC Worldwide Clarifies Bank Amendment Terms

OVERLAND PARK, Kan., June 18 /PRNewswire-FirstCall/ -- YRC Worldwide Inc. (Nasdaq: YRCW - News) today clarified that the amendment it finalized on June 17, 2009 to its revolving credit facility with its lenders has the same terms in regards to total liquidity and capacity under the facility that existed prior to yesterday's amendment. The new amendment does give the company immediate access to the escrow funds of $73 million by means of revolver capacity that can be borrowed at any time without approval from the lenders so long as the company's cash is below $150 million. The $150 million is a new maximum of cash and cash equivalents that was mutually agreed to by the company and the lender group and set well above the company's average daily cash usage. The company's total liquidity includes its cash balance in addition to the availability under its credit facilities, which in total was $242 million at May 31, 2009.

Lufthansa, DHL Launch Joint Cargo Airline
Both give downbeat forecast for global air cargo market
Lufthansa Cargo and DHL Express gave downbeat assessments of prospects for the global air cargo market June 19 as they officially launched their joint cargo airline, AeroLogic.
The new carrier will start service on June 29 with a Boeing 777 freighter flying from its hub at Leipzig airport in Eastern Germany to Asia.
"Our business is an early indicator, but we have no backlog, so I cannot say how things will develop," Deutsche Post DHL chief executive Frank Appel said at an inauguration ceremony at Leipzig airport.
"Until April we saw neither improvement nor deterioration so it looks as though the floor of the crisis has been reached," Appel said.

Last month I said that June was significant for two reasons. First, we are going to get our first test of data that could disappoint, which would spell trouble for an overbought market. But, just as important, we need to watch the industrials because there is going to be no sustainable recovery unless these cyclical companies are leading the way. Lufthansa to take over UK's BMI
Settlement with Michael Bishop gains Heathrow slots
London -- Lufthansa, Europe's second largest airline, on June 22 said it will acquire control of BMI British Midland next month after agreeing to an out-of-court settlement with the majority shareholder of one of the UK's leading independent carriers.
Lufthansa also said it will proceed with the acquisition of am initial 45 percent stake in Brussels Airlines and plans to take complete control of the Belgian carrier by 2011 after getting approval from European competition regulators for the $90 million deal.
Lufthansa is also awaiting European Union clearance for its planned acquisition of Austrian Airlines.

Teamsters proposal would give YRC more operating cash
YRC Worldwide Inc. may get more leeway from its major union, which would provide more operating cash.
According to the Web site of Teamsters for a Democratic Union, a union reform organization, the union proposes that the national contract with YRC be amended to defer pension payments for about 14 months, allowing nearly $500 million in savings to YRC. The proposal includes YRC getting more bank credit and hiring a turnaround consultant.

YRC Worldwide Inc. will lose its place in the Standard & Poor’s MidCap 400 index Monday because of its falling market capitalization.
YRC had a market cap of about $100 million at the close of trading on Monday, which ranked it 400th in the MidCap 400 index, S&P said. YRC’s market cap, calculated by multiplying its share price by the number of outstanding shares, fell 7.1 percent on Tuesday, to $93.3 million.

Art Cashin: Next Two Days Critical
Monday was the worst day for stocks in about two months. Art Cashin, director of floor operations at UBS offered his insights Tuesday.
In his Tuesday note to investors, Cashin said that the S&P was not able to hold on to its 200 day moving average or its 50 day moving average. That's a key point for Cashin.

fedex deserves what they get. They wont lower their rates even in this economic funk. I hope UPS swallows them up. I dont know how many times I have heard Fedex sells a premium service so the rates had to be raised. Wake up Fred customers are looking more a shipping prices rather than just the service now a days.

Better-than-expected durable goods orders send shippers' shares up
Shares of major trucking companies and package shippers rose Wednesday, as investors took heart from better-than-expected durable goods orders in May.
The Commerce Department said orders for durable goods -- defined as things that last three years or more -- rose 1.8 percent in May. Economists surveyed by Thomson Reuters anticipated a drop.
The Dow Jones Transportation Average rose 3.2 percent in midday trading, with all 20 component stocks higher.
FedEx shares rose $2.86, or 5.6 percent, to $53.61. UPS added $1.17, or 2.5 percent, at $48.37.

LTL trucker, union to reopen labor contract for second time as company seeks ‘operating capital’
Six months after winning a 10 percent wage cut from its unionized workers, YRC Worldwide is back at the bargaining table. The troubled company — the largest LTL operator in the country — is asking the Teamsters to help it reduce costs again.
The $8.9 billion carrier, which is trying to stave off bankruptcy, will open talks with the Teamsters June 29 to modify the terms of its current labor agreement.

HELENA, Mont. (AP) -- Attorneys general from Montana and seven other states Thursday asked FedEx Corp. to ensure that FedEx Ground properly classifies its drivers to comply with state employee protection laws.
Thirty states are investigating FedEx Ground to determine if the company is misclassifying FedEx drivers as independent contractors through its owner-operator model. And more than 45 class-action lawsuits have been filed in state and federal courts against the company's classification of drivers.

Wyoming Eyes Tolling on I-80
The Wyoming Department of Transportation is considering placing a toll on Interstate 80 across southern Wyoming due to a shortfall of revenue needed to maintain the highway. The state is working on a study to determine the viability of the venture, which should be completed by Sept. 1.
The tolls would hit truckers pretty hard, as trucks make up about half of the highway's traffic and truck traffic on the route is expected to more than double over the next three decades, according to the department. To maintain the highway at its condition for the next three decades, the state would have to shell out $6.4 billion.

Although truckers hauled less freight in May compared with the same month a year ago, the contraction was the best year-over-year result in three months, and tonnage actually increased compared with April of this year.
“I am hopeful that the worst is behind us,” said ATA Chief Economist Bob Costello, “but I just don’t see anything on the economic horizon that suggests freight transportation is ready to explode. The consumer is still facing too many headwinds, including employment losses, tight credit, rising fuel prices, and falling home values, to name a few, that will make it very difficult for household spending to jump in the near term.”

Traders Already Eyeing Earnings
This week traders are focusing on housing as an indicator of the strength of the economy, and will have plenty of indicators to digest. The S&P/Case Shiller index will be released tomorrow morning, and May construction spending and pending home sales slated to be released Wednesday. Analysts expect pending home sales and construction spending to be fractionally negative, a reversal from April’s positive move.

Extension comes as sales begin upturn
UPS will continue to deliver new cars to dealers under an extension of its logistics contract with Ford Motor Company.
“While the nation’s automotive industry is currently undergoing a dramatic upheaval, UPS’s finished vehicle logistics model effectively reduces costs for manufacturers such as Ford,” said Paul Hargadon, general manager of UPS’s Automotive Industry Solutions Group. “UPS has been working with Ford since 2000 and has provided improved transit times while lowering logistics costs.”

Trucking stocks have rallied over the past four months despite the sour U.S. economic conditions, but the recent rise in shares is a fragile one, analysts warned.
Between March 9 and mid-June, all but three of the 36 publicly traded fleets’ shares gained value. Con-way shares more than doubled in value, and Arkansas Best Corp. rose 88% to lead the rise among individual companies. The Standard & Poor’s Trucking Index gained more than 61% over the period, outpacing the benchmark Standard & Poor’s 500, which climbed 42%.

The 3-month winning streak was the longest for the Dow since Aug.-Oct. 2007. However, the other indices continued on to a four-month rally. For the S&P 500, up 0.02% in June, this marks the longest streak since June 2006-January 2007 (8 Months). For the Nasdaq, up a more substantial 3.42%, it’s the longest streak since August 2006-November 2006 (4 Months). And for the Russell 2000, up 1.34%, it’s the longest winning streak since August 2006-January 2007 (6 Months).

NAFTA Trade Plunge Accelerated in April
Deepest dive yet in seventh straight month of declining business
The surface transportation trade between the United States and its North American Free Trade Agreement partners Canada and Mexico declined 33.1 percent in April compared to April 2008, according to the Bureau of Transportation Statistics of the U.S. Department of Transportation.
April was the fourth consecutive month of year-over-year decline of more than 27 percent. The decline was the steepest in the seven months of declining business. April surface trade totaled $49.7 billion, down 2.6 percent from March. In April 2008, surface trade with Canada and Mexico was at a high of $74.3 billion. About 88 percent of U.S. trade by value with Canada and Mexico moves by truck, rail and pipeline

RFID Sales Projected Growing 5 Percent
Forecast says retailers, governments fuel growth despite downturn
Worldwide RFID sales will increase 5 percent in 2009 to $5.56 billion despite the global economic downturn, according to a forecast by IDTechEx, an international market research and consulting firm.
The firm said sales of RFID tags, readers and software/services for RFID cards, labels, and other products and services are growing even amid the widespread reduction in inventory and shipping.
The report said many segments of the industry are growing at an annual rate of more than 10 percent.

ISM Manufacturing Index Improves in June
Manufacturing levels in the U.S. improved last month but still showed overall contraction, the Institute for Supply Management said Wednesday.
ISM’s monthly factory services index for June rose to a reading of 44.8, from 42.8 in May, ISM said in its monthly report.
Figures of more than 50 indicate expansion, while below that shows contraction.

Consultant: Overcapacity hurts trucking
The declining overall economy and freight demand both are starting to find a bottom, but overcapacity remains a major concern, warned Eric Starks, president of FTR Associates. “Trucking has limited upside over the next four quarters,” Starks told attendees of the 2009 CCJ Symposium yesterday, June 30, in Birmingham, Ala.
Credit is available, but banks are reluctant to lend to trucking, Starks said. Another phenomenon contributing to overcapacity is what Starks called “zombie truckers” – fleets kept alive by banks that would rather keep them afloat instead of repossessing their equipment. Regarding the used market, many companies are upside down on their trucks, and replacement cycles have been extended because of better equipment and fewer miles being put on it, which Starks said will lead to no measureable prebuy of less-expensive equipment prior to Jan. 1, 2010, when tighter emissions regulations mandated by the U.S. Environmental Protection Agency go into effect.

Technology firms extend truckload carrier groups' reach into shipper freight networks
Truckload carrier Landstar System is expanding off-road by acquiring two technology companies that give it greater reach into shippers’ freight networks.
The Jacksonville, Fla.-based trucking and logistics holding group bought Premier Logistics, Detroit, and A3 Integration, Ann Arbor, Mich., spending about $2 million.
Landstar is creating a new subsidiary, Landstar Supply Chain Solutions, to house the companies.

Road fatalities hit 47-year low
The U.S. Department of Transportation today announced the number of overall traffic fatalities reported in 2008 dropped to the lowest level since 1961 and that fatalities in the first three months of 2009 continue to decrease. The fatality rate, which accounts for variables like fewer miles traveled, also reached the lowest level ever recorded.

Western Express will now operate as one company and under one name following its acquisition of Smithway Motor Express in October 2007.

Stocks capped their third straight down week with a sharp drop Thursday as a weak jobs report muzzled all the green-shoots talk and investors hunkered down.
"The jobs report was weaker than expected and it throws a little cold water on the economic-rebound story," said Alan Gayle, senior investment strategest at RidgeWorth Capital Management. "I think the market is growing a little impatient with less-bad reports — The market was hoping for less-bad and it got worse than bad."

FRANKFURT, July 5 (Reuters) - Package delivery giant and U.S. economic bellwether FedEx Corp (FDX.N) is seeing signs for a potential turnaround in the second half as production seemed to be picking up again, German magazine WirtschaftsWoche reported.
Michael Ducker, in charge of FedEx' international business, told WirtschaftsWoche in an interview to be published on Monday that the downturn was easing and its internationally transported volumes had not fallen further compared with the previous quarter.

NEW YORK (AP) -- UPS Inc. said Tuesday it has adopted a plan to reduce the carbon emissions of its air fleet by 20 percent by 2020.
The world's largest package delivery company said it plans to achieve the goal by investing in more fuel-efficient aircraft and jet engines, finding more ways to conserve fuel and introducing biofuels
UPS has a total of 263 aircraft, making it the ninth largest airline in the world. It transports an average of 2.1 million packages and documents by air each day.

'Lightning Alliance' to speed LTL freight between South, Midwest, Northeast
Milan Express and New Century Transportation formed a “Lightning Alliance” to speed less-than-truckload freight from the Midwest and Southeast to the Northeast.
The alliance extends both carriers’ reach, expanding Milan Express’s territory northward and adding New Century’s “hybrid” LTL and expedited services to its portfolio of service offerings.
New Century Transportation, Westampton, N.J., has a direct-to-load model of LTL carriage first devised by its chairman, Harry Muhlschlegel, for his previous company, Jevic Transportation. Freight is delivered direct rather than through a hub-and-spoke terminal network.

Manufacturer says Class 8 can save owners up to $6,000 a year in fuel, operating costs
Freightliner Truck, the largest heavy truck maker in North America unveiled a natural gas-powered Class 8 tractor June 7 aimed at the port, drayage and utility markets.
The Business Class M2 112 NG not not only cuts pollution compared with its diesel counterpart but can save as much as $6,000 a year in annual fuel and operating costs, Portland, Ore.-based Freightliner said.

Trucking jobs drop in June
Payroll employment among for-hire trucking companies in June dropped 0.9 percent from May levels and 9.2 percent from June 2008 on a seasonally adjusted basis, according to preliminary figures released by the U.S. Department of Labor’s Bureau of Labor Statistics. The latest numbers also reflect a slight upward revision in trucking employment levels for May and a slight downward revision for April.
With the estimated 11,000 jobs lost in May, the trucking industry has lost more than 75,000 jobs since the end of 2008 – a decline of 5.6 percent. Job cuts since the beginning of August when trucking job cuts began to accelerate total 124,700, or 9 percent.

Bankruptcy at YRC Worldwide still likely: Morgan Keegan
July 8 (Reuters) - Morgan Keegan said a bankruptcy at the struggling U.S. trucking company YRC Worldwide Inc (YRCW.O) was "still likely in the near to mid-term" and moved the stock to "not rated" from "market perform."
The union has offered a deferral plan for pension payments in the short term, while YRC has proposed to the Teamsters a termination of pension payments for about 14 months, with the value of those payments totaling about $500 million, analyst Art Hatfield said in a note.
YRC's proposal, if agreed to by the union, will provide the company with much-needed liquidity, the analyst said.

Rothschild reviewing possible YRC bond deals: source
CHICAGO (Reuters) - Struggling No. 1 U.S. trucking company YRC Worldwide Inc (NasdaqGS:YRCW - News) has asked investment bank Rothschild to evaluate potential bond exchanges as part of its restructuring plans, according to a source familiar with the matter.
Rothschild which specializes in mergers and acquisitions and restructuring, including providing bankruptcy advice.
YRC has also been working with financial advisory firm Tenex Capital Management for six months on restructuring plans.

Restructuring consultant says rumors about possible YRC Worldwide bankruptcy are 'overblown'
NEW YORK (AP) -- An executive from one of the companies called upon to offer a restructuring plan for YRC Worldwide Inc. said Wednesday the prediction the beleaguered trucker will soon file for bankruptcy is "overblown."
Financial adviser Tenex Capital Management is guiding the company through the steps of restructuring while avoiding a bankruptcy filing. Responding to several reports of impending bankruptcy in an interview with The Associated Press, the person asked to remain anonymous because of the sensitivity of the talks.
"We don't think filing is the most effective way to do it," this person said. "We believe there are ways to make this work without bankruptcy."

'Brutal' Cargo Market Hammers Air France-KLM
Europe's top cargo carrier considers temporary layoffs, director general says
The head of Air France-KLM said Thursday that Europe’s biggest airline is mulling part-time jobs or temporary layoffs to combat the “brutal” situation in cargo and passenger air demand.
“We don’t see the slightest bright spot. The reduction in demand in cargo is brutal,” Air France-KLM’s director general Pierre-Henri Gourgeon told the Figaro newspaper. “The drop is also very high for premium passengers,” he said.
Air France-KLM, which is also Europe’s top cargo carrier, in May said it plans to shed 3,000 jobs in the fiscal year to end-March through attrition.

Teamsters, YRC Reach Tentative Agreement
Details not released, but Teamsters note 'shared sacrifice' with company
The nation’s largest trucking company, YRC Worldwide, reached a tentative agreement with the Teamsters union to address the beleaguered carrier’s cash problems.
The tentative agreement followed reports July 8 that the company and union were not likely to reach a deal and an analyst said a bankruptcy was likely in the near term.
Details of the agreement were not released July 9, but the union said it calls for “shared sacrifice” by the company and its 35,000 union employees.
“We are confident this tentative agreement balances the need to provide job security while maintaining good quality jobs,” he said.

DOT Freight Index Falls 14.8% in May
The Department of Transportation said its freight transportation services index fell 14.8% in May from a year earlier to its lowest level in 12 years.
The drop to 94 was the largest May-to-May drop in the 20-year history of TSI calculations, DOT’s Bureau of Transportation Statistics said in its monthly report Wednesday. The TSI fell 0.6% from April.

Truck Orders Show First Boost in Three Months
June truck orders for all major North American OEMs rose 9.7 percent from May, according to a report by FTR Associates. This is the first rise in three months.
"June's increase is a welcome sign that the heavy-duty market continues to stabilize, although at very low levels," said Eric Starks, president of FTR. "We expect to see additional slow improvement through the end of the year, but meaningful increases in equipment purchases will necessarily await higher freight demand. We do not foresee more freight moving for some time yet."

S&P's Stovall: Pullback to 810 is Likely
"We're going through a corrective phase now," said Stovall. "A digestion of the 40 percent advance off of the March 9 lows."
"We could see the S&P drop to 800 to 825" before the picture is clear, he cautioned.
Pointing to the "head and shoulders" formation that many technical analysts are seeing, Stovall said the "height between the shoulder and head could bring us down to the 830 level."
And he believes "we'll probably go down to about 810."

YRC Worldwide’s stock rose 60 cents to $1.49 a share July 9 on news that the financially strapped trucking enterprise reached a tentative agreement on cost cuts with the Teamsters union.
After the agreement was announced, the stock hit $1.49 by the close on July 9. It fell about 10 cents to $1.39 per share by noon July 10.

New ethanol, hybrid delivery vans boost alt-fuel fleet to more than 43,000 vehicles
The U.S. Postal Service is greening its fleet of delivery trucks with 1,000 E-85 ethanol-powered and 900 hybrid gasoline-electric trucks.
The purchase of 1,900 ethanol and hybrid electric vehicles — part of a plan to replace 6,500 aging delivery trucks — puts the total number of alternative-fuel vehicles in the USPS fleet at more than 43,000.
That’s almost 20 percent of the 220,000 vehicles used to deliver mail.

Canada-U.S. Trucking Sees Bad First-Half
Cross-border trucking over the Ambassador Bridge connecting Detroit to Windsor, Ontario, the busiest commercial connection between the United States and Canada, fell by nearly a third in the first half of this year. At other key crossings, traffic was little better.
There were 173,202 truck crossings either way between Detroit and Windsor, in June, a 32.7 percent decline from the 257,276 in June of last year, according to the Public Border Operators Association (PBOA). For the first half of this year, to June 30, there were 1.1 million truck crossings, a 31.1 percent drop from the 1.6 million in the 2008 period.

Volvo research could lead to trucks at least 20 percent lighter within a decade, resulting in less fuel use and lower emissions.

The Teamsters union would gain a seat on YRC Worldwide's board of directors and other concessions from the company in return for a 15 percent overall wage cut and a temporary waiver on pension payments under an agreement to help the struggling trucking company avoid bankruptcy.
The wage concessions — a 5 percent cut added to a 10 percent cut the Teamsters accepted early this year — and the 18-month stop on all pension payments could save the company more than $1 billion over the several years.

Heartland Profit Grows, But Outlook Dim
Truckload carrier sees operating efficiency improve sharply from last year
Truckload carrier Heartland Express defied the economic downturn with a 2 percent boost in net profit in the second quarter, but the carrier said July 14 it sees little improvement in the economy and no “strong indicators” demand for freight services will increase in the near term.
Heartland's operating profit edged up 3.8 percent from last year, to $21.7 million and its operating ratio improved from 87.3 percent last year to 81.4 percent this year. The company said its operating profit for the second quarter was helped by $4.2 million on an increase in gains on disposal of property and equipment.

There is no shortage of threats to our economy. America's unemployment rate recently hit its highest mark in more than 25 years and is expected to continue climbing. Worries are widespread that even when the economy finally rebounds, the recovery won't bring jobs. Our nation's debt is unsustainable, and the federal government's reach into the private sector is unprecedented.
I am deeply concerned about President Obama's cap-and-trade energy plan, and I believe it is an enormous threat to our economy. It would undermine our recovery over the short term and would inflict permanent damage.

Union employees could receive ballots on wage cuts, company offer by next week
Teamsters at YRC Worldwide’s motor carriers will begin to receive ballots as early as next week for a vote on a plan to steer the troubled carrier clear of bankruptcy.
If the process runs smoothly, YRC and the Teamsters could seal their deal as early as the first week of August.
The agreement would give the Teamsters a seat on YRC’s board of directors and the option to purchase up to 35 percent of the $9 billion company.
“I think it will pass, but not with as big a margin as the last vote,” one YRC driver familiar with the plan said. “A lot of guys are really concerned” about their pensions, but also about what would happen to the company if the plan were voted down.

Teamsters consider extra 5 percent YRC Worldwide pay cut
YRC Worldwide Inc.’s union members will weigh an extra 5 percent pay cut on top of losing their pension contributions for 18 months, the union said Tuesday.
Teamsters for a Democratic Union, a union reform group, said Tuesday that the wage cut is worth about $1.16 an hour and would begin immediately following a positive vote. The pension withdrawal is valued at $7.60 an hour for the first 12 months and $8.20 an hour for the second part of 2010, TDU said.
“Unfortunately, the freight recession has worsened for all trucking companies as 2009 has progressed, but it’s been more aggravated at (YRC) companies than any other trucking group operating in North America,” the Teamsters said in a document.

Economic recovery will be 'a slow climb,' forecaster FTR Associates says
The trucking industry is towing too many empty trailers to gain the speed it needs to reach a recovery, says FTR Associates.
Excess capacity helped drag the transportation forecasting firm's Trucking Conditions Index down two points in May to -22, indicating the industry remains "in solidly negative territory" well below the neutral reading of 0, FTR said.
The index, published monthly in FTR's "The Trucker's Dashboard," combines five trucking statistics into one metric measuring the overall health of the industry. The decline in May broke with three consecutive monthly increases.

Industrial Price Index Signals Recovery on Track
Raw materials price growth points to broader improvement, end of recession, ECRI says
Global industrial production is on track to recovery, albeit in fits and starts, according to the trend signaled by the industrial price index compiled by The Journal of Commerce and the Economic Cycle Research Institute.
Meanwhile, as ECRI predicted in April, the U.S. economy remains set to see the recession end sometime this summer. This is despite the general feeling out there that what economists are calling “green shoots” have withered, as reflected by the pullback in stock prices.

Landstar’s 2Q Income Declines
Truckload carrier Landstar System said late Wednesday its second-quarter net income fell to $17.9 million, or 35 cents a share, from $29.8 million, or 56 cents, a year ago.

Southeastern Buckles Down to Continue No-layoff Tradition
While many carriers have good chunks of their workforce on long-term layoff, Southeastern Freight Lines has been taking serious measures to keep its people working, continuing the company's 58-year-old tradition of no layoffs.
The last year and a half has been the most difficult time to protect that. When the economy started crumbling last fall, the company assembled a "Keep Our People Working Task Force," to get creative about making sure employees had enough hours. Currently, Southeastern employs 6,700 people, including 4,600 drivers.
"The easy thing to do is to lay people off," said Mike Heaton, senior vice president of sales and marketing. "The hard thing to do is to figure out ways not to do that."

Stock Markets Are Up Again
I agree with publisher Mort Zuckerman who recently wrote that subprime jobs numbers in the U.S. foreshadow continued economic weakness. But the stock market seems to disagree with both of us.
Stocks are roaring ahead again today — up over 150 points — after holding the high ground yesterday and following Monday’s huge rally. Even a sub-par retail sales report didn’t stop retail stocks from posting a 1.6 percent gain.
