ABF did open their books and the Teamster Leadership decided concessions were needed, but it was voted down.

What is there to cry foul about is Article 6 Section 2. The employer agrees not to enter into any agreement or contractwith it's employees, individually or collectively, which in any way conflicts with the terms and provisions of this agreement. Any such agreement shall be null and void.

Simply put......YRC is in violation of this contract.
Did ABF open there books for the IBT? NO. Would ABF let a Teamster to sit on there board? NO
But the IBT let ABF have there 15% concession vote and it was shot down.

Hoffa might be a lawyer but I would not hire him. You cannot extend a contract for one company that other company also signed. This violated the NMFA. Getting the 15% give back is not the problem, it changing the language and extending the contract before it expires. If you are stupid enough to give your money back then that is your business, But you cannot rewrite the contract for one and still keep the contract for another.

I don't think that's it at all. I don't read that. ABF is a very straight forward company, and they said they simply want YRC to go by the current contract and they want reperations.

What is ABF seeking in its legal proceedings?
ABF’s goal in the grievance and lawsuit is to enforce the NMFA and have the YRC-only amendments declared null and void and to obtain compensation for the damages sustained by ABF as a result of paying much higher wage and benefit costs than our largest NMFA-covered competitor.

This is great, ABF wants my pay back to rate and my pension paid in full. Wow Christmas may come early this year!!! BTW "NMFA" what the hell was that anyhow?

Could you get hired at ABF. Remember YRC empolyees are not from a commonly owned carrier and have NO preferance.
And if they win YRC will not have the money to pay so they will turn over the pink slip. Then we will have a job at ABF.....what more could we ask for. :stirthepot:
