XPO | Conway driver fatality in accident today?

I pray for his family, friends and collegues. It is a reminder of the pure fact we all will die one day one way or another.....just be ready and live an Honorable life while here.
 
My thoughts and prayers go out to this young mans family.The dilemma we face when driving in inclement weather is, what I deem as unsafe someone else might not.When you call our almighty folks in L/H the first thing out of their mouth is"other drivers made it,why can't you".We all have different driving abilities and no one should be faced with termination when refusing to drive in what a driver feels is unsafe conditions.
 
We need to start a new thread so we do not trample paying our respects to a fallen driver.
Get the foul weather stuff into a new thread.
I'm ready to chime in there.
 
Yea I would have to agree .. there are alot of strong opinions on this subject. It is a hot button with alot of could have should have and would haves. I firmly believe we do not have the whole story on what happened here. I want to know but I dont want to know you know what I mean ? :duh:

I definitely want to know what happened but I have a strong feeling the details will never be revealed or known, other than the reports that say he hit ice, was not wearing a seatbelt, rolled over and succumbed to the accident.
That picture does not show the full area of the final resting place of the tractor. It's only showing the background of the highway that looks too distant. How far was the highway to the right side of that picture?

Whether he was forced or whether he took the run willfully, that's just pure speculation, the fact is he took it and was driving in unsafe weather conditions not buckled up (Per law).
I'm thinking there is a potential for a lawsuit and this is going to be a total hot topic that any member of management will avoid.

I vote on making a new topic to discuss driving in unsafe weather conditions, being forced to run, having your job threatened with the stupid "Are you refusing work?" statement etc.
 
Why do you say this oldtimer50? Are you singling him out because he is management?
Not all TM's are the same way and it appears Boxboss does not condone this type of behavior other members of management have instigated in getting the freight moving.

What I would like to hear as well as others is:
What happens when a driver refuses to drive in foul weather because they feel it is unsafe or beyond their scope of driving?

When does it not become "Refusal to work"?

I know we are all professionals and should be able to drive through these but with intimidation being the factor (refusing work, being late etc.)

When does a driver have a leg to stand on when it comes to weather conditions?

How are you going to explain this without setting a precedence? Is this going to be a case by case basis?
FOS's, management, G.O... please chime in and help some of the drivers that want to know.

These things when they happen are the deepest felt loss a friend, associate, or company can experience.

Finger pointing at this juncture is fruitless and destructive. The subsequent investigation will determine the cause.

Moving on...

You as a professional driver are Captain :captain: of your own ship...period!!. It is you and you alone that is responsible for the safe operation of your rig. You are expected to make determinations as to the safety of your equipment and road conditions on a daily basis. It is your job. The company hired you, continually trains you, and counts on your daily evaluations of various circumstances to safely operate their equipment.

When it goes wrong (and sometimes in your career it will!) you will be the first person they look at. Like it or not that is just the way it is...

If you refuse to leave the terminal in adverse weather conditions this can be misconstrued as failure to follow work assignments. You risk an insubordination problem by doing so.

If you leave the terminal and then return saying the conditions are too bad to continue you run into the same problem. The response will be "If was too bad to continue then how were you able to return?"

Years ago as a union steward I ran into this scenario constantly. Drivers would leave the terminal and then return to the terminal saying the conditions were just too treacherous to continue. While I did not dispute the call (remember I was driving in the same conditions) I always told my guys "DO NOT RETURN TO THE TERMINAL..."


If you are out and away from the terminal and the conditions are too dangerous just stop and call. Inform your supervisor as to the problem and then let them decide on the next course of action. And whatever you do do not let them talk you into continuing! They will try...trust me!!!!

You must have all your ducks in a row! Don't call and say the conditions are bad just because you do want to deal with the circumstances when it would be possible continue at a slower pace. You are professionals...

Keep in mind your supervisors are also thinking of customer service. Afterall, that is all we have to offer. They are on the bubble too! If you leave the responsibility and resulting decisions to them then you are off the hook.

You have made your determination and then they will make theirs. Quality decisions will be made. It is just as much their responsibilty as yours to maintain customer service and safety in the process.

The FOSs at my barn are phenomenal!!! Everyone of them have been at it for more than 20 years. They have seen it all and 'been there...done that!!!'

Just don't try to blow smoke...if your determination is based on safety issues then so be it!

Everyones priorities are straight BB ... By what you have read here in your time on TB does not scratch the surface of what goes on system wide.
Force from the bottom that is the mentality for a job no ones wants to do... it would not surprise me in the least if linehaul forced that man out to go help the triples drivers. More often then not every other carrier pulled all their drivers off the road in really bad storms... and here we are ..in an Oklahoma ice storm.. where is the integrity on this BB.. all of us HOURLY employees in most other places rather than your barn have the yessem boss attitude to survive and that is not fair at all because this companies core value is integrity? safety? commitment? excellence? bull **** dude .. losing a driver over a trailer full of freight. No freight is worth anyones life. And I hope some sort of ACTION is taken whether legal or somebody gets terminated over this .. regardless it wont bring Marcus back .. the permanent damage is already done.

But losing a member of our team is always awful...

The unfortunate truth is you are right more than you realize.

This is the worst sort of tragedy that there is....A family member was lost today, perhaps a father, a son, a brother, a husband, a grandfather maybe...most definitely a co-worker...And what do we get to read?

"I hope they sue the hell out of the SOB that FORCED him to bobtail in those conditions..!!!!"

Which one of you on these boards was standing next to this driver when he was being forced by a white shirt to go out and get killed..!?!?!?!?!?! Which one of you..!!?? Raise your G** D**** hand right now..!!!!

None of you, that I am sure of...

Some of you disgust me to no end at times...

Shame on you....There is only one thing important at the moment, and that is this man's family...I do not know him, never met him I am sure, but he and his family are the most important thing on my mind..

UPDATE:

Unsafe speed for icy road conditions is listed as the cause of a fatal accident that killed a semi-truck driver Monday on the Turner Turnpike.

The roadway was icy and it was raining and sleeting at the time of the accident. The OHP said Hawthorn was not wearing a seat belt.

I really would like to know more of the events that leads up to the accident. We dont really know for sure if he volunteered or was forced and how fast he was driving etc ... BoxBoss is not on trial here ... nor am I or Justadriver or ... you get the point bottom line

His family lost a loved one. I have one friend I lost in this business to a very unfortunate accident. One of the finest people you would ever want to meet. I have seen some dandies in my time as well as everyone else. The one that sticks out in my mind that forever changed me was the night I got a phone call in the middle of the night on a weekend for a driver fatality. I was an Operations manager at the time and I drove on sight identified myself and was told the man did not make it .... I knew the man I saw him all the time where I use to work droppin loads off or passing thru .. They (state patrol) asked me if I could identify him and I did .. there was not much left. I hurled about 2 seconds after I saw him.
 
My thoughts and prayers go out to all the conway families that have to live thier lives in fear for their jobs...

I was just reading this post. Im a FedEx dock worker and Id like to say a prayer for the family and friends of the worker you guys lost. I really hate hearing about drivers being killed or injured cuz through it all...and whatever company we work for.. were all family and are just trying to make a buck.
