Whoever got the company to agrre to using a transfers transfer date to the new terminal for layoffs is a genius and whatever B.A. argued this and won is a genius,but oh so wrong. I could see it if it was post contract that he transferred,but to of been at a terminal for several years when this wasnt the rule and step out on the rule for layoffs it was your hire date for layoffs not for bidding i understand.I have lost 17 years now and should of been grandfathered in, but i really thankyou for this screwup.I use my hire date for vacations, and my retirement,but now for the most important layoffs my new terminal date. What a crock of crap.

My friend this is one for the books. I can't believe this one myself. But it is going to have to be battled in the courts.
Company seniority the date of hire should be only for layoffs. Terminal seniority should be for bidding. That's the way it's always been with Overnite.

Overnite had it's faults been it never stooped this low.
 
I am confused, I thought layoffs were by full time hire date before and after the contract was ratified. How have you lost 17 years? I am not sure I understand your post.
 
this is happening at our tm men with 15-24 yrs with company are being layed off because they are using their transfer date for the layoff, even though they transfered to follow work before we went union. this is plane bull sh*t. we were also told at our last union meeting by our sec/tres/ba that the one line seniority was just hear say , they have no conformation of the one list seniority .

I would think that this would be a win for the members as past practice was clearly a dovetail situation when following the work. These type's of interpretations by the terminal/company would be out of the question with one single seniority list.
 
...hmm,BusterNite do you know of any person that has transferred in the one list barns that is going by company time..period..I find that grounds for some serious litigation with the NLRB, IF the grievance avenue fails..

No, I do not know anyone at all who has transferred and is still with the company. Maybe someone from New England can shed some light here. I hope you guy's get this straightened out. It just seems as though layoffs has always been by company time transfer or not. I have not seen this problem in New England "yet".
 
this happened to me last year when it got slow. but a little differnet, according to UPS i was not "layed off", they had me classified as " on-call" due to company seniority. i was on-call due to classification seniority and people with ALOT less compnay time then me where working. union told me it was a transfered into a differnet classification.
are you sure your laid off and not on call?
when i called the union to get a withdrawl card so i would have to pay dues while being laid off they were the ones that told me that UPS had me listed as on-call.
it would have been nice if they would have actually called me instead of waiting 3 months. then my first 2 checks went completly to the union. thanks guys.
 
It is best to call HR and have them change your status to laid off. They will do it if you ask. UPS has this weird soft layoff deal which is actually active on call. No benefit to them or the employee. I never could make sense of it. But if you call they will change it.
 
if we go by article 5 like the contract says it will clear all this up but when we let the company make deals the company will not go by anything article 5 says that the frist day you worked as a probationary employee is the employee's seniority for ALL PURPOSES so stand up for your rights as a union man with a grievance with the company or the NLRB and let the contract work for you good luck my union bro.
 
the regional (south) nlrb has told us that they can not help us with the seniority issue the mou stating that all ssd time does not count for anything other than retirement time or earned vacationtime the time used for lay-off at gaf is the date you transfer into the terminal including anyone that transfered from any other ltl terminal we've got guys with 20 25 yrs that will get laid-off before guys with 8-10 yrs there has been an appeal to washington nlrb but there is no guarantee when it will be heard even though my hire date is 1997 at the gaf terminal then transfer to ssd after 16 months then back to gaf in 2003 i lose all time as far as lay-off

I guess going into this thing we didn't have the expertise or contract savvy UPS has and they stuck it to us. This is just one way of getting rid of the higher senior drivers that cost them more. Because of this you will probably see a lot more contractors and more layoffs. It may cost them now but they are forward thinkers.

if you changed classification like from city to road, you would have been on call if you went to extra board, and not in the 90 percent, the drivers would have worked over you if you took a non guaranteed schedule, and there was no layoff, our terminal goes by hire date for layoffs,

i have not been able to bid, since im a 10%er. i have no choice. if i did go to road i would be working the dock with all the other 10%er raod drivers. not so in the city. have been told that i can't become a road driver, can't switch unions. our term is not allowing any movement, several dock guys got thier CDL and have been informed they have to work the city for 2 years. <past practice> but can't switch unions to do so. been told they can become raod drivers with no driveing experiance if they were hireing, but would have to quit and get rehired. ups policy is not to rehire anyone. :TR10driving03:
