Sounds like someone in management trying to put out BS.I had L5 surgery and right shoulder surgery.I had to get pins put in my shoulder and it had not stopped me from getting a job. If he got hurt at work he needs to make yrc pay for his injuries.

really? You had to get pins put in your shoulder and it had not stopped you from getting a job. Good for you. Who would do that? Maybe they were desperate. The only people who will get a job now are the cream of the crop. The young and injury free. That leaves you out brotha stick. The man is asking if he should collect? Bengay might work in that case
 
From my experience (if the company screws you out of on the job injury) comp pays very little in New York and it’s for six months, after that your done. Never think twice about filing a report, even if it’s minor. Small injuries sometimes come back to haunt you and then it’s too late.
 
Comp in NYS pays $550.00 a week Tax Free and they do not cut you off after 6 months.

They look to cut you down and off as soon as is humanly possible. Just got accepted for SS Disability on a full disability, yet comp doctor downgraded me from total to partial temporary disability and now I have to go to a comp hearing because they want to suspend or lower my payments. Funniest part is that his reports say the same exact thing they said when I went to see him 3 months ago and he found me totally disabled. Amazing how I miraculously got better.
 
A little freindly advice would be appreciated. I've never put in for workers comp in ny. before and am wondering if I should or not. I hurt my shoulder real bad on friday and am in a bit of pain am wondering if i should try and work through it or go to the doc. and do i gotta go to there doc or not. ps. i did fill out a report

Many of the replies give you good advice, but take it from me.........
I was injured in a vehicular accident in Sept of 05.
Hurt my left shoulder, neck, head, and back.
Did a few months of physical therapy, then had shoulder surgery.
A few more months of therapy, and then returned to work.
Worked for 13 months, and re-injured my back.
Did 2 more years of therapy, then had back surgery this past May. And more therapy since.
Still not perfect, may never be, still unable to work,and just started receiving SS Disability Income.

My advice to you is simple.....
You've already filled out a report.
Take tomorrow off and go see an Orthopedist of your choice.
Go for x-rays, MRIs, whatever he asks for. Follow his instructions to the letter.
You need to be out 10 working days before you can receive any Worker's Comp benefits,
but they will be retroactive to the day you stopped working.
Since you have never done this before,
I highly recommend you retain an NY Worker's Comp Attorney.
If you need one, send me a PM, and I will refer you to someone.

Are you talking about on the job injury?? When I got sick off the job and had surgery and couldn’t work they paid squat for six months. There’s a difference, otherwise I would gladly let you break my leg ASAP. if a report was filed at work good. if not, not so good.

What you are referring to is supplemental disability payments which are much lower than Worker's Comp payments, and they are also taxed. Also realize that every state has different payment schedules.....

Why in the world would you expect Worker's Comp to pay you for something non-job related in the first place?

Animo is right on the ball,I fell in 03 and shattered my right arm,yellow was smart enough to get me back to Kentucky for treatment.Little did I know that Kentucky is the worst state in the union you can file workers comp in.They treated me like a thief and a commom criminal.All I ever told them is that I wanted to heal up and return to work so I could retire in 2009.Their doctor said I would never be able to perform the kind of work I was doing but would only give me 25% disability.I told him to release me to work and watch me.Two surgerys and a lot of physical therapy later I made it to 57 years old and told yrc to kiss my *** and retired.My arm is still crippled but I made it.What I am saying is GET A LAWYER and A GOOD DOCTOR and FIGHT<FIGHT,FIGHT.Good luck

Yes you have to go to there doctor first, but then you go to YOUR OWN, do not let them take care of you, and ask around you will need a lawyer find yourself a good one, especially if your dealing with gallager basset
 
I thought I tried helping this guy before. Never try to handle this by yourself. GET a lawyer that handles Workes Compensation, Medical Malpractice, Slip and Fall Accidents, that type.
 
Unemployment didn’t give me a choice when I got sick, they refused me.

Of course they would refuse you. Why would you expect to collect unemployment when you got sick? To qualify for unemployment you have to be fit and able to work don't you?

I guess I assumed he could have gone either way with it and maybe looking for a way out of the coming possible fiasco.. I have a friend who's son had a cerebral hemorrhage of some kind. He collected for about two years. Then he was declared 100% by doctors and could not get his old job back as a prison guard. They said he couldn't pass a physical. No one will hire him now. He's losing his house. Another friend fell off a fire engine, hurt his leg bad. Got a settlement years later and then the city said he was fit to work but would not give him his job back. He sued and got his job back and earned his pension time and retired. If you go on workmans comp with a minor injury you get your $550 a week wow whoopy do and then get thrown out when x-rays look good. That's all you're gonna get paid and then you struggle if you need a new job
 
i don't know about getting 550 where your at in ct. but here in maryland the comp pay is 2/3 your average pay over the last 14 weeks before your injury. this is also tax free. it's not to bad if you have a good 14 week average.

I believe it's against the law to ask a job applicant about their worker's comp history in some if not all states.
