I signed mine like 3 days ago. Seemed benign. I read it, didnt seem too scary compared to some of the **** we agree to, online and stuff. I copied the address so Im going to request my full file, they have on me.

This is the story we were told when asked to sign over permission to pull our credit report. And let me be CLEAR , my terminal manager NEVER mentioned credit report. He said it was for permission to pull driving records to meet DOT requirements.
 
Our Service Center already has a signed permission form to pull our DMV report in our personnel file. They check our driving records every quarter.
If this new form is only for our DMV report, then why is there all of the other items on it, ie.. information regarding my character, general reputation, personal characteristics, and mode of living.
It also allows your information to be transferred across international borders.

Check my driving record every hour on the hour if you want, but all the other information is not necessary and only invites the opportunity for ID theft.

This is in response to your letters of December 8, 1997, and December 15, 1997, request-ing the views of the Commission's staff on the following questions involving the application of the Fair Credit Reporting Act ("FCRA") to the activities of your clients:
1. If an employer obtains only driving records and criminal records information about potential employees from a third party, is the information covered by the FCRA?
Yes. Section 603(d)(1) of the FCRA defines "consumer report" to mean any oral, written or other communication by a consumer reporting agency (CRA)(1) bearing on a consumer's "credit worthiness, credit standing, credit capacity, character, general reputation, personal characteris-tics, or mode of living" which is used, expected to be used, or collected in whole or in part for the purpose of serving as a factor in establishing a consumer's eligibility for, inter alia, credit, insurance, or employment. To be a consumer report, information in the report need relate to only one of the characteristics enumerated above. Since driving records and criminal records do con-tain information about a consumer's character, general reputation, personal characteristics, or mode of living, these types of information are covered by the definition of "consumer report." I have enclosed another staff opinion letter (Poquette, 6/10/98) that discusses this point.
When an employer obtains information from a CRA about the driving record or the crim-inal record of an individual, the employer is a "user" of information covered by the FCRA and must comply with all provisions of the FCRA that apply to users of information obtained from CRAs. The most significant of these provisions are Sections 604(b) and 615(a), which require users of information for employment purposes to make various disclosures when adverse actions are contemplated and taken based upon consumer reports."

What appears to be effecting this annual process are newly enacted state laws like California's that require the additional information on the request form. Apparently one law fits all. Whether it's our annual MVR report or someone running a credit check, the same info on the request form applies.

There is a mention of "A Summary of Your Rights Under the Fair Credit Reporting Act" that you may request a copy of from Verifications, Inc. that I'm sure covers other things besides only credit reporting.
I believe that you authorized the company to check your credit report when you signed your employment application also.

Im gonna request to see what kinda **** they have on me.
Probably not a bad idea for EVERYONE to request info about what is on file with these guys. I would give it a while until they have actually collected whatever info they are looking for. Did I mention...EVERYONE should request their file? Hint...EVERYONE! Get it? Got it? Good!

you are allowed to see your file. You just cannot leave the building with it, make copies and the TM has to be present.


As for the investigative report, its a DOT mandate that companies run at aleast an annual driver check

I wouldn't sign the form that said this. Two days later I was given another form with different wording. They eliminated "information regarding my character, general reputation, personal characteristics, and mode of living". And the new one stated driving record only. I felt comfortable signing that one.

I would hope that will be the company-wide form. Can't see them having different ones floating around.
