If your doing a turn, you can't. If you have a laydown run you can. Don't forget you can also charge for laundering your uniforms.
 
I know a driver in Kansas that got audited by the irs and he had been claiming per diem on a turn run and he had to pay all the taxes back
 
so when we have to take a lunch per dot, we can take it then right? over night drivers ?

No. A required rest break that keeps you away from your home domicile over night or day. There is no requirement, per DOT, to take a lunch, yet.

Guardrail is right on this one, in the end you can do whatever you want but then you're taking your chances with the IRS not finding out. I trust the government don't you? :)

My CPA has me take partial days. I do a hub turn and am in the truck 12-14 hours a night. It is a gray area, I think wroth fight for if it comes up.

If your'e wrong,keep in mind the IRS not only collects the back taxes but they'll tack on intrest(based on prime rate!)all the way back to when you started claiming the deduction.
 
don't confuse 'per diem' with 'meals and incedentail expenses', if your anticpated work shift is longer than 6 hours( not 100%sure on that number but it's close) and you are XX miles from home and are regulated by 'hours of service' regulations you allowed to take the meals and inc. expenses deduction. I have for over 10 years and never have had a problem.
 
This is not brain surgery. If you start and finish your run at the same domicile you cannot claim meals. If you layover in a hotel for 10 hours at another domicile you can claim meals. Actually you can do anything you want to, the only problem is if you get audited, the first thing they will ask to see is your last years logs. I know, been there done that. TP
 
I would also tend to agree with a Certified Public Accountant as to tax rules instead of a buncha drivers. :)
 
I go by what the IRS says. It stands to reason that there are some CPAs out there that rival the quality of drivers out here.

you are correct guardrail. Have been audited. Once for meals. Had to repay claimed amount.

This comes up every year, My tax lady gives me days away at half pay, you have to work for 10 hrs or more,and run interstate. I've trusted her for 20 plus years and she hasn't let me down. As a matter of fact she re trained herself when I come off the road 16 years ago to Ltl, so she was better informed of this style of trucking. I have been told Turbo Tax even lets you take your days. It cost more but get you a CPA that serves Truckers and Farmers it's worth it, and you can write that cost off next year too! Just remember what is good for me may not be good for you!
 
A quick thought on this as well, I know some drivers who buy a new radio every year and claim it on their taxes. You will get burned for this as a cb radio is not something you have to have in order to do your job.
