Screw the weather report, they brought in temps - not new hires but temps to work the docks at KCI today... wonder what the legality of this is?
 
Temps as in Manpower etc? If that's the case the Union needs to step it up. If they can bring in temps they can hire some people. Let those temps pay some union initiation and dues and start their hiring process.
 
Supposedly, they are going to only be there for a week until we get caught up. That's what the word is. And yes, TEMPS.
 
If they are on a Union dock, you must insist that they join the Union. If you don't,.....then about every two or three months,...especially around vacation time,....you will see ABF use those "temps",....until it just becomes a "normal" practice. There is language in the contract that prohibits ABF from contracting out any dock work. Using "temps" is a slimy, backhanded way of getting around that. If ABF has contracted to Manpower,...or some other group similar to that,....they must immediately start signing these people up and putting them into casual/preferred casual status and getting their names and addresses and initiation fees off of them. It doesn't matter if ABF has "contracted" to these groups or people,.....we already have an existing contract with labor provisions for casuals in it which both pre-dates and supersedes anything that ABF is doing outside our contract with a third party. Protect your work! See all those food warehouses who have lumper services weasel their way onto the dock and destroy good jobs. Where you once had 5 receivers on a food warehouse dock,...you now have 1 receiver, and about 7 lumpers with no benefits, no layoff provisions, terrible pay, and no pension. And the food warehouse has "contracted" to the lumper service, so it has no loyalty, no liability, and absolutely no interest in that lumpers' future. All because some Unions were lazy enough to allow lumpers on the dock,.....to do the "heavy" lifting. I don't know about you,....but if an untrained temporary "worker" was within about 15 feet of me on a dock, I would throttle down to an absolute safe crawl ,....maybe almost to a standstill,...until I was sure that the "person" was out of my "safety" zone. Your job is too important to lose it because an untrained idiot doesn't understand safe procedures on a freight dock. Personally, I would be frightened for my job every time one of these untrained so-called temporary workers came near me. Frightened into immobility..........
 
I saw on the Old school forum a guy in a pissing match with another guy who discredited him in use of Hogan Inc's drivers and mentioned a temp service.. Gues he was right...
 
Article 32, Section 3. of the Master Agreement specifically states that there shall be no dock work farmed out except for existing stuations established by agreed-to past practices. So, if I am reading this correctly, unless this practice has been done in the past at 003 and agreed to between the Company and the Union, it should be a contract violation no matter if it is a temp service or an interline (third party) service.

I think the company and union agree to quite a bit in KC.. Thats what has the workers a bit up in arms.. Local 41's BA's and President are weak and not interested. Also the center of 2 key negotiators of this contract. Sweeton is from Joplin Mo, and Alden is from KC and on KC's road board. I dont think the city steward and BA get along but BA is retiring! The road steward is ******** and their BA is an alcoholic. Its a mess. The men are weakened and could care less what happens on road, they just make their 90,000 yr and move on.. The city side has a handful of guys that are vigilant but whats a guy to do with all the not getting along and union meltdown? So in a nutshell... the company does whatever it wants!! and under their noses!! I read that post on the other site.. Seems alot is going on under the noses of ABF workers and it was brought up, 1 guy who knows it all supposedly wasnt aware and goty offended,, well this temps on the dock is another example of union weakness and men against each other and turnig the cheek...
 
When Atlanta needed some extra dock hands a few weeks ago, ABF brought in dock hands from other terminals. I saw some guys from Orlando and Winston working in Atlanta.

That's better than losing customers because freight don't get delivered...
 
I'm pretty sure the grievances have been filed on this. No past practice has been established as such. Shop Steward spent yesterday and most of today putting it all to paper. The following is what I have heard from my brothers on the dock so the information may be somewhat wrong. just putting that out there. :) CO spent lots of money on these guys bringing them in town. putting them into hotels, buying them cold weather gear, meals and other expenses. once again, that's just what I've heard. I hope the truth comes out in the grievance procedure.
 
I'd say that if they'll do that for temps they should do it for the regular employees too. Food and room allowances 'round the house. At least that way they'll only do it if they really need to.
 
What doesn't make sense is bringing them to town? I know that ABF has shuttled casuals before, they have sent KC casuals to Denver before! flew them there, put them up, per diem, etc. Nothing wrong with it and they have 30 days to obtain a union card.
 
Casuals is one thing, temps is another. I can see no excuse for temps to be utilized.
 
Didn't we go on strike back in 1994 over the issue of part-timers? If anything , the situation, economically, regarding part-timers, or temps, or anything outside of the current contract language , and the abuse thereof, has gotten worse over the years. Hey, Tyson! This is in your back yard,.....why don't you go down to K.C. and earn your paycheck by straightening that Local out? C'mon, buddy,....we'll all cheer you on,.....ride your big white horse into K.C. and vanquish those who would dare to allow temps on your turf......Surely you're not too busy to enforce the contract you were so proud of a couple of months ago?
 
Tyson is afraid of KC, Sweeton stood up to the guys.... Greg Alden (whatever his position is) but an IBT man,, He ducked out and hid at our contract meeting,, word is, he will run for Local 41 President!! LOL!!! I could not agree more,, this is a striking matter, but the local gave them permission!!!
Vic Terrinella, President!! I would still do an unauthorized strike,, push the local to the brink as well...

How about the city yard men helping the purchased transportation drivers out in the yard, slide tandems, just all buddy buddy.. pulling trailers out in the clear away from other trailers, etc.. tell them to pound sand!!!

They would be dropping in the 460's which is the staging area for hooked outbound sets and the dock hostlers would be putting their trailers away or bringing them up to the gate for them to hook. That's our yard and they are hauling our freight. They aren't ABF employee's and shouldn't be given the full run of the yard that they are being given.

I fully agree that people who are unfamiliar with our yards should not be bobtailing or running around without supervision. They should be sent to a designated area. Many of these terminals are already too congested. However everyone should remember that the purchase transportation drivers are just trying to feed their families like the rest of us. Don't treat them badly on a personal level. If the company tells you to do something you don't agree with, do it (unless its a safety issue) and then grieve it.
 
On Monday 03/10/2014 they started working five agency casuals here at 004 as they did in 003 last week. I was all set to file under Article 32 on this issue. As I was looking for other language in the contract to help back up my grievance, I came across Article 3, Section 2.(c) which basically say's that the company can use an employment agency provided they pay the agency fee. It goes on to say that if the local union was given equal opportunity to furnish employees under Article3, Section 1.(c), then they do not have to pay the fee until after the 31st day of employment. So, I have given all this information to my business agent to see if there is anything that can be done about this. I hope that he can come up with something, but with that language in Article 3, it does not look good. I will keep you posted on how this turns out, and any suggestions would be greatly appreciated as I feel this is nothing but a loop-hole for ABF to legally subcontract dock work.
