XPO | lunch b4 8 hrs

You Americans have access to the employee handbook on the portal still, correct? I believe the lunch between 4th and 6th rule is in there. They will not allow us to have access to it up here.

Like any rule or policy at the con dash way. It's all subject to whatever the person in front of you says at the moment.

Give it time. And the person and the " interpretation " will change.

lol, security breach! They have done an employee handbook for the portal, but they will not post it. If they post it, they have to abide by it.
 
You guys sure whine alot. The lunch rule for the city says lunch SHOULD be taken between the 4th and 6th hour. If you cannot you are to contact dispatch for instructions. Them making you take it back at the service center is wrong but not against the rules. There is not longer a lunch exception form. It must be taken or you lose that time.

it is against Conway's own rules. You must take it between the fourth and sixth hour. It's on dispatch to make it happen. And yes, there is still a no lunch form. My guys filled them out Friday. Maybe if dispatch wouldn't overload the drivers with 15 pick ups, while he has a full load of deliveries and leaves the gate at 11:00 am, the city guys could take a lunch at the proper time.

You guys get out BEFORE noon ? Man I am jealous !

I usually take mine on the way back to the barn. But I don't start until 1030. So I have until 1830 to get it in and be all legal for DOT. By then I will have delivered as much as I can and be done picking up or at my last stop.

"Should" doesnt make it a rule, it makes it a suggestion subject to management's mood of the day. If you are not allowed a lunch during the 4th and 6th hours then its management's fault and you shouldn't be forced to take it any other time.

1st things first, this is an actual topic, one of the very few legitimate threads on this forum. Its about the real world and an issue P&D drivers face daily so take your "whine" comment to the "Conway Sucks" thread where all the real whining is going on.
2nd, dispatchers DO NOT HAVE THE AUTHORITY OR POWER TO MAKE A DRIVER TAKE HIS LUNCH BACK AT THE SERVICE CENTER. It is both wrong and illegal to attempt to force a driver to do that. A P&D driver can take his lunch anytime he wants after his 4th hour, PERIOD.
 
The new thing at my terminal is now they are trying to tell us that we should be taking our lunches while we are waiting at customers for a long period of time.

You are still responsible for the vehicle and its contents and therefore are still being paid and thus NOT on lunch.

Correct. I even went so far as to find and print out the statutes and told them if they wanted to press the issue, I'd be glad to forward their number to my lawyer.

According to the DOT, if you can't walk away from the truck and cargo, leaving them unattended for 30 minutes, it is not a break.

§395.8: H; (1) Off duty. Except for time spent resting in a sleeper berth, a continuous line shall be drawn between the appropriate time markers to record the period(s) of time when the driver is not on duty, is not required to be in readiness to work, or is not under any responsibility for performing work.

Is that the way you all read this? I mean if you have to log your day, your break would be on the Off Duty line. Right? Looks like to me, if you are on a customers dock, you aren't able to log "Off Duty", you would have to be on the "On Duty Not Driving" line.

I wouldn't say we "lose" that time so much as it is "stolen" or "taken" from us. Good management or dispatch ensures that their staff receives duly earned breaks at the appropriate time. Not when they hit the gate.
 
I like you dcmilkwagon, pull out the DOT regs and answer the question definitively. Nicely done, very good post.
