I don't deny anyone the right to find employment. I hope all the drivers and management move on to bigger and better things. What I don't understand is how some people react BEFORE looking at the long term consequences. Protect yourself before your employer should be the motto. I honestly think that those former NCT employees that followed the PIED PIPER don't realize the legal position they put themselves in. Once the investigation is opened and the NLRB and lawyers representing all who filed with the WARN ACT, get the records......and there are records that follow a trail to those involved.....These men and a woman are in for a rude awakening when there's a knock on their doors from the federal marshals. It may not happen next week, maybe even months or possibly years from now, but the federal government will put all the pieces together, sew it up with a ribbon and a bow, and deliver justice when justice is due. It's all in the timing...so make all the money you can kids...you're gonna need every cent to pay your lawyer!!!!!
 
Nah not gonna happen people could care less who what when it's all window dressing to how bad we were run. It's over on to bigger better things.
 
Surprised like who. The jevic employees are still waiting for their 50 cents. It's done an people don't give a hoot they are worried about keeping their own lights on right now.
 
big difference, JEVIC filed in Delaware, rules regarding STATE WARN ACT favors employer, NEW JERSEY protects the employees....I received all monies due me whwn REDSTAR went out under the NEW JERSEY WARN ACT regulations. 60 days severence,1 week for each year of employment, vac and sick time, and holiday pay during the 60 days severence.
 
You really need to watch yourself on a class action lawsuit and ask plenty of questions. How much does the lawyer take? Is the fee a percentage plus expenses? Is there a cap on expenses? If there is a settlement, and that's a big IF, you all could end up with very little. You can bet the law firm or firms will get their take though! Good Luck
 
not sure what the fees are...I have no vested interest since i've been out of there since 2012 but the state lawsuit fees are covered on their dime along with any federal suits, the class action suit was brought on privately and i'm guessing will be the standard 1/3, which still gives the employees 2/3 of something they never had.
 
have read the class action lawsuit disclosure letter. it is a contingency only basis. drivers should sign up....it will only cost NCT and what is left of it. a violation of Federal and NJ WARN laws are taken seriously by DOJ at both levels. one thing is still interesting...a last minute pulling out by a mayor financier but there was time to set up to still service accounts , very substantial accounts i'll add, for some reason the time table just doesn't fit. there will be a dated paper trail to look at. prove fraud? who knows...but it doesn't smell kosher from here. no one will care? BR trustee will be all over this if it even looks a little shady...DOJ has thousands of lawyers available...to investigate actions like this. it might take awhile but it could happen.

Class action fee are determined by the courts. They always favor the lawyers. The "class" get little to nothing. they also take no risk. The warn action (if there is one) will be prosecuted by the state and all legal fees a\will be paid by them

Based on what happened at Jevic, nothing. WARN, while law, has to be fought out in the civil courts. The NJ version has more teeth.
The Jevic people who went with the NJ suit got paid. Not a lot but something. As for the union, I have no idea. Maybe if the vote comes out yes, you guys
would have representation.

Reality is, sucks a lot of good people lost their jobs. Dust off and move on. Trust me, most will land in a good spot.
Maybe better. I did.
Hindsight, why did I stay with Jevic?? The dollars was not worth it.I might still be married if I went local rather than their road work
