Monday we had a Owner Operator drop off thirty skids at our dock. Normally this wouldn't be a bad thing, but the freight was picked up in Cranbury,NJ,and was for one of our biggest customers,Amazon. It gets better,7 of these skids were for Amazon DC in Hazleton,Pa which is in our city operation. The other 23 skids were picked up yesterday by another owner operator being delivered to Amazon in Spartanburg,Sc.Oh yeah and it was on a ABF Logistics Multimodel bill.My question is this,no specialized equipment was needed, and nothing was on the bill about a customer request for this move. IMO this is just the tip of the ice berg, I can only imagine how much other freight is being robbed from us.Now if this is part of the 6% that some of my brothers and sisters voted away I for one would like to see a print out of the amount of purchased transportion!!! IMO this should have been picked up by ABF trucks. This is the second time this has happened, not to mention we have found out other freight being picked up in our city area of ops in this manner. Any opinions?

Welcome to 3pl

Not a dam thing you can do. The customer hands their freight off to Logistics and they find the cheapest way to get it moving.
What you are seeing is some cartage or owner operator doing what you used to do and doing it cheaper with no benefits.
ABF still got the freight and the money in their pocket..................

Yes, there is a dam thing you can do. File a Lawsuit for damages & discovery. One thing though, good luck in you fund raising drive to pay for the attorneys. von.

I beg to differ brother.
Their is no case. This move was never ABF freights until it was signed for at your dock. You cannot tell a company how to move their freight.
Even though it came from ABF Logistics a sister company and 3d party logistics provider.
Been throught this with a trade show organization that shipped 3pl to YFS where it was loaded onto trailers and then taken off site to be worked by non union sister company ( Reddaway) then final delivery by YFS city drivers.

I'm afraid he's right, Brother Von,......However,....we do have language regarding diversion of freight , ....it's just a logistical hassle trying to keep all the information straight,...plus getting the IBT to take your charges seriously,......I don't know how many of you guys have taken a case to Eastern Region ,at Myrtle Beach,.....but I can assure you it's a real snake pit. Our higher-up so-called Union officials get to hob-nob in a fancy resort with their company counterparts,.....and ,..dang it!....those pesky, stinky employees with their pitiful grievances ruin a good vacation on the Local's dime every time!......So,.....getting Tyson Johnson up off the plush bottom of his office chair, and actually doing something about enforcing the rules regarding diversion of freight, and sub-contracting, and purchased transportation,.....will be pretty implausible, in my opinion. We'll probably have to wait for a General Election year to,....maybe,....see some enforcement of our contracts in an effort to pander to us to get elected,.....In the meantime,......unless your Regional Grievance panel is much more,........shall I say?...."responsive"...to the rank-and-file's needs than mine,....I'd suggest keeping a file on as much information as you can gather,........Don't bother taking individual instances to a Grievance panel,......Wait a year, and walk in with 60 or 70 cases, all documented........It'll be an embarrassment to both the company, and the so-called "negotiators" that allowed "purchased transportation" language in our contract.........Don't forget to send copies to your local NLRB panel, too.......

Yes their is language on diversion.
All the customer has to do is put it in writing how they want their freight handled.
Remember your contract is with the company not the shipper.
The company with letter in hand to the local and your dead in the water.

Just running my mouth here, But that would NEVER happen on a Longshoreman's dock. Not a chance in hell.

Last Union Contract

Last teamster job that was full scale, benefits, and pension contributions.
You all gave a lot more than that !!!!!!!!!! BUT, BUT, BUT you all voted Y E S. GOOD LUCK with that. Bet when you get blind sided with the next trick you'll say I never saw it coming. ( End of this year coming) Pension reductions and Hoffa wants congress to put and end to elections for teamster president. Afraid of retaliation.

Good point,......But we're still under the Consent Order, and Congress would have to end that, first, to clear the way for a convention change to our IBT constitution,.......Oh,...wait,....Didn't the IBT just recently jam through a change to Art. 12 with the help of the UPS negotiating team,.......vote was 60 to 4 against,....my Local President being one of those against,.....(....he has the guts,.....and the Morals,...to stand up to the IBT.....).......and this change affects ALL National contracts,.....and, of course,....the REST of us didn't get to vote on that,........Maybe we will get President-For-Life Hoffa......Yeah,......maybe he should get Life,.....along with his complicit cronies......R.I.P. NMFA 1963 to 2013. Done In By The Son Of The Man That Created You.

Harte Hanks used to do this all the time when I worked at another company. Mostly post office deliveries of flyers for mail route distribution. Vertes is another printer that uses brokers to move their shipments to end of line terminals.
