He said the truck was unable to back off the tracks before the train hit because traffic had backed up on the road behind him.
It was the FAULT of the trooper escort in not eliminating the traffic congestion problem by BLOCKING THE ROAD.
Had the trooper escort actually THOUGHT AHEAD, such wreck might well have been avoided.

NOT The Trucker's fault.

A number of folks to blame here. Since it was an oversize load, why wasn't the routing examined and evaluated for the ability to turn an extra long vehicle at all the required places? Why didn't the trooper via the police dispatcher instantly contact the railroad when the truck first began to have trouble getting off the tracks? The train could have been given an emergency "slow order" approaching that crossing which would have enabled it to stop before reaching the crossing if it were still obstructed. More than a few people dropped the ball on this incident in my opinion.
 
Turns out genious driver was driving on a suspended license 3rd offense multiple citations for speeding and reckless driving. :tr10driving03:
Curious where you might have seen this. I didn't see a reckless driving charge in his past.
IMO the media is spinning this to stir folk up.
His last incident was an overweight ticket.
He may have turned it in to his company and they lost it and so for got to pay it.
Sure, he's got some bad stuff in his past but people change.
I think he deserves to be given the benefit of the doubt here.

I am unfamiliar with acquiring Permits for Special Routes or Special Routing Permits.

Such Valid License is REQUIRED (for some reason/s) to be presented at many shippers/receivers as well some fuel dealers, so is not such a requirement when applying for Over Size/Over Wide/Over Length Permits??

I agree, some Drivers need be given a second chance and Texas used to do just that regardless of from where a person originated as well did Tennessee and most probably some other states.

I agree with the "routes should be corroborated prior to travel to insure (ensure?) the safety of the motoring Public as well of TRAINS and other vehicles like Horse & Buggy, Moped, Skateboard (not flatbeds), Bicycles, Pedestrians, visiting Extra-Terrestrials, Bunnies, Coyotes, wandering alcoholics and unicycle riders, etc."

Not knowing the LEGAL bits of issuance for Permits, it seems the following would be fully applicable (according to what I know not or with have experience):
Failure in ANY PART OF THE ROUTE for clean continuance (except through Driver Incompetence) shall then become the whole and complete responsibility of the issuing party regardless of monetary compliance to satisfy all Parties involved--or words to such effect.

Hopefully for the Driver, the entirety of the accident/crash/wreck was not much his fault.

Last time I got a permit it stated the one getting it had to make their own route and make sure it was safe. The company and the driver.I was routed a few times over load limit roads and once where a bridge was deemed unsafe for heavy loads. If you have an escort I believe it falls on them to make sure of the route since they have to be bonded.

I find it hard to believe any state would allow a driver and company to find their own route for oversize loads. In Illinois the state routes the truck. If you are found to be off route by law enforcement, you will have a big problem.
