ABF | Excessive Overtime

Maybe you can file a grievance under National language, such as Art. 5 . Seniority. You can claim it is being violated every day by his earlier start, especiae if this earlier start was consistent. Is there a chance you could defer the 9:00A.M. bid start to him, and you take the earlier on call start?

Yes. Next bid cycle I could do that.
 
He does fill in for guys on vacation, but most times they just start him earlier than me to get freight rolling sooner. We have a couple of volume accounts that we can hit early. That's the only reason he starts earlier than me. Most days I'm on OT before I even get back to the terminal. Does that still allow him to leave earlier than me? SAC75...what part of the country are you in?
If you hit overtime before he clocks out you have the rite to go home before him. Im in Kansas City/omaha region
 
I don't know if it applies to any of you, but at my barn we have a " no overtime sheet". Any driver can sign it, and management has to do their best to get us off the clock in 10 hours or less. I believe (not 100% sure) that they can write you up if you sign the sheet "too often", but I haven't heard of any cases yet of someone getting written up. Some of our drivers sign it fairly often, but I think most (even though they complain about it) want the overtime.
 
Our Supplement (W. Penna.) says that if the company "consistently" works you over 10 hours, you have the right to grieve it. Their inability to hire should not become our problem,......or our families' problem. And,.......guys who "have" to get 12 hours a day to make up for lower wages,........you've just fallen for the old " carrot on a stick" trick......you might as well save all that overtime money for that solid gold coffin your heirs can put you in after you've worked yourself to death......The short-sighted
idiots who negotiated this contract..........on both sides..........created these conditions where the company can't hire people,.........I'll be damned if I help them "solve" their problem by working excessive overtime,......at the expense of my family.

Is the objective to make sure the bottom guy gets screwed every day? Even when he finally gets a decent shift for a while make sure he's miserable.

Anybody want to change places with the 10%er all the times he's on a late shift. Same rules apply to the guy that's been here 2 months or 30 years. Can't be forced over 10 unless your on cleanup.

That's not the issue at all. The issue is paying your 'dues' exactly like the people above you on the ladder did. This garbage of changing the 'rules' when a guy who WAS on the bottom finally moves up, has paid his dues, and earned the right to be able to FINALLY get off work BEFORE a person below him does. That's the issue. We've all been on the bottom at one time or another. We work hard, and finally move up. That's how seniority works.
 
I agree, however, those on the top of the board,......having gone through the good, bad, and ugly on the seniority board,.....should have a little empathy for newer employees. And........as we all well know, the company isn't above taking advantage of seniority envy to foster a little dissension in the ranks,......and possibly get work rules changed in their favor,..........or even entire contracts, for that matter........... Seniority is not rank,....this isn't the military,.....we all pay the same in Union dues,.......There are times when we have to step up and help a younger Brother, especially if the work rules are impacting his family,........and there are times a junior man has to realize that the rules in place were hard fought for,..... and there for a reason,........not to punish lower seniority members. ALL companies hate solidarity,......and they enjoy watching the top half fighting with the bottom half........
 
A disclaimer: I am Number 1 in seniority in our barn. I'm also the steward........ I told my assistant steward that if I ever started strutting around and exhibiting symptoms of " Numberoneitis"........he is to slap me in the back of the head and bring me back to earth. I'm not supposed to rule from the throne........

I agree with you. When i was the bottom guy i got to go home early just because the guys felt like i needed it every once in a while. That helps a lot when you close a barn every night. I do understand the other side of it too when a jr guy is going home almost every day ahead of you. If your lucky enough to have some people who get along well it makes for a great place to work. If you have to work with uncaring people, it can make a monotonous unfriendly place too.
 
Being singled out for dock work day after day is an issue that could be and should be handled right at the terminal like adults. If the sup is doing it to you he/she knows it and talking to them will probably not help but you could give it a try so you can say that you did. Then to the TM and explain what is happening to him/her and that you are not happy about it and that you would like them to help get it straightened out. If you could get your Shop Steward on board it would be to your benefit. I have seen this work and I have seen it not work. Then a chat with the B/A who you do pay should get him/her to take a look at it. They can go in and tell the TM that we all know what they are doing and ask them to knock it off. It would be best if you kept yourself a little pocket sized spiral notebook just for this process and keep notes include dates and times when you were done wrong. I wouldn't have much faith in winning a grievance but you could give it a whirl. Obviously they prefer you on the dock over the other guy and that is why they are doing it. They have the ability to manipulate the delegation of the manpower to however suits them...we are comparable to the men on a chess board and can be hopped around to almost square they want us on when they want us there. Any denial to the contrary is a lie on their part. So....should none of the above work you can do what I have seen done before and provide them with the necessary incentive to get you off the dock. Follow their rules to a T...count your freight, recoup anything that looks like it could use attention, make damn good use of your dunnage and pack those trailers picture perfect. Check all of your labels and pro stickers and make sure that they match, any questions sashay on in to the sup and have them check it out right then and there. Be very careful and safe on your forklift, don't drive too fast and always yield the right of way to everyone else so there are no accidents. Use your seatbelt faithfully and inspect your forklift before use in accordance with OSHA and company regulations. I really hate driving over those pallet splinters that lay all over the place and running them over aggravates my back so I always get off of my forklift and pick them up too. Anything not working right get the right paperwork and report it. And don't be afraid to double check anything you question, I know those browsers are slow but that's not our problem.
