ABF | Uniform Grievance

You really can't lose at the national. They are going to address the point of order and decide where it will be heard. If it means anything I just won a grievance at the national committee that affects UE. So I got a fair ruling there and it was a major ruling for all UE drivers.

What was the nature of your grievance?
 
If you guys have noticed, ABF has had Cintas gather up the jackets, and rumor has it that they are going to put both the American flag and the Teamsters emblem on them,......forestalling any further grievances about whether the jacket is in compliance with Art.12......it's a hot potato, according to my B.A. No one wants to rule on it.

A note was hung on our bulletin board sometime this week about the jackets and Teamsters patch.

I was unable to cover my bid start time due to ABF not getting me a tractor in time to run my UE run to SB.

I broke down and it took 6 and a half hours to get me a tractor. And I could not cover my bid the next day.

I filed for the trip and it went all the way to the national committee. My argument was that if we are held accountable for protecting our bids then so are they. And the committee agreed. Received $430.00 the amount average per trip.

I don't understand what their problem is...such expenses are all part of doing business when you're running 800,000 mile trucks. I'd like to hear what you did for all that time. If you sat in that most uncomfortable tractor the whole time time you probably need a regimen of treatments with your chiropractor too. For some reason I thought you were a road driver? There's quite a pay cut from road driver to UE.

Not necessarily. If the UE run is an older mileage run, there is actually an increase in the mileage rate for the UE compared to the road. A lot depends on how much hourly pay is involved. The more mileage and the less time spent paid hourly, the higher the average pay. If the distance is long enough so that you basically have only enough time to drop and hook at your turn point I think you could do really well. Possibly better than the road, (for the same time worked) and you get home every day (unless you break down and spend half a day in the truck :poke:).

I know some guys are waiting for an update...... So are we. Apparently, ERJAC in Myrtle Beach ruled on the Point of Order as to whether the grievance can be heard there,...... and they haven't released their decision yet. The B.A. in Local#249 and my B.A. have both inquired , to no avail yet. Maybe the decision floated away in the floodwaters.........Jackets arrived back from Cintas with a Teamster patch,...no American flag. Back they go.......And apparently there's a memo out about hats,.......Several separate grievances have been filed over hats,.......none here,......and I think that you can now wear the hat of your choice, as long as it's not offensive,....... Yeah, I know it all seems like a little deal,....but it actually goes right to the heart of what it means to be a Union member, and Solidarity with other Union working people. Mr. Hoffa says : "Bring Jobs Back To America." ......and I'm presuming he also means my Guatemalan company-mandated uniform...... By the way, Art.12 doesn't delineate between different groups of employees,......... It says " employees ",.......not " customer-facing" employees......... Every road driver, dock worked and UE guy should have access to this uniform program,........every employee, as per the contract, as it were. ABF made up that part about " customer-facing". Wouldn't it be nice if we could make up our own language in the contract?

If it was the only issue it might be a little deal but it just adds to the pile of ::shit:: that makes the job not worthwhile. We're being castrated and many of us are just not fine with it. It seems that the new breed doesn't mind and we're a bunch of outgoing crotchety old men anyway. How petty does it have to be? What ever happened that showing up for work and doing our jobs is now insufficient?
 
Any details on the hat grievance situation or jackets, I presume there going back for patches???
I don't know much a about a grievance on hats. I was shown an e-mail stating that due to "several" grievances, ABF was no longer enforcing a "uniform" violation on hats. We've filed no grievance on hats in JC 40. Personally, I still don't know how they can impose mandatory uniforms between contracts...........Ooops,..,....I forgot about our clueless, spineless ....."negotiating"...…...team......How about mandatory uniforms for only part of the bargaining unit? How about making accessories to the uniform........ Coats,hats,.......that aren't contract compliant mandatory? Bit by bit, piece by piece, they chisel away at the contract, and make up language.....such as "customer-facing"...... as they see fit. And,......of course we have no contract books, starting into our third year of a five year agreement. Can't you just see the signs at the convention next year?...." Where's my Contract?"........"Bring Jobs Back To GuatemalaSo They Can Make My Uniform".........All this should be embarrassing,........ If they had any shame.......

If it would've been in the company's favor, they would've trumpeted it all over the place. Now all we're waiting for is a docket date back at ERJAC. Hopefully before December. Glacial speed.........
 
We had a grievance hearing on a separate issue last week, and it came out that the decision on the Point of Order was ruled in the Union's favor. Why all the secrecy? If it would've been in the company's favor, they would've trumpeted it all over the place. Now all we're waiting for is a docket date back at ERJAC. Hopefully before December. Glacial speed.........

The Point of Order raised by the company at the initial grievance hearing in Myrtle Beach during the summer was that since the Union had given approval for ABF to implement Art. 12, that there was no grievance issue in how ABF went about " complying" with the provisions of Art. 12...........In their estimation, they had done nothing grievance. We beg to differ.......I have yet to find the words "company-facing" in the Article,.........we have found many Union vendors,....... And,......as I sometimes wear my Teamster jacket as it is more appropriate to the weather and my health and well-being on occasion,.......I am fond of pointing out the American-made, Union-made tags on these articles of clothing,.....which should answer the allegations that there are no American uniform manufacturers anymore.

The panel agreed with our grievance premise and dismissed the Point of Order, thereby allowing the grievance to be heard, ....or rather, be put on the docket to be heard. Stall tactic, because the company's case is pretty weak? Who knows?

Thanks for the clarification. You notice in the new abf company catalog they are offering uniforms again? I'm hoping they go back to the way we use to do it..
