Three questions;

I see a lot of drivers catching long vias at the end of FAC ops that will put them driving past 14 HOS - punch to punch. Isn't the 16 hour rule ONLY to be used for adverse conditions???

"Adverse driving conditions means snow, sleet, fog, other adverse weather conditions, a highway covered with snow or ice, or unusual road and traffic conditions, none of which were apparent on the basis of information known to the person dispatching the run at the time it was begun."

Also, based on this quote from FMCSA definitions, can you be dispatched if the weather is bad or even forcasted to be bad on a run that could go over 14 hours???

How does one deal with illegal (if it is illegal) dispatch???
 
There is a provision for use a 16 hour day if 1) the driver is released from duty at the same location the previous 5 duty tours or after 34 hour reset. ( no overnights ). 2) extends work hours only not drive time. 3) And that driver is released from duty within those 16 hours. I use the 16 rule once a week and only recently became aware of the qwirk in #3 "must be released from duty within the 16 hours" any time over is a violation, post-trip, paperwork, or whatever.

Adverse condition rule and the 16 hour rule are not the same rule.

According to the rules we at conway can be asked to use our 16 hour rule to do a via.

you can not be asked to use the extra 2 hour drive time to do a via.

If you go out in bad weather it is illegal for you to use your extra 2 hour rule to make it home.

Keep in mind, the 16 hour rule, without regards to the adverse weather conditions, can not extend driving time, only on duty time for that day. You can not add an extra 2 hours driving time to satisfy the 16 hour rule.

In adverse conditions however, you can extend your driving time by 2 hours, if you would have normally made your run in within the parameters of the HOS regulations. One exception to that is, for example, if you leave your terminal for another facility, you experience the adverse conditions while on the first leg of your run, and know that you can't conceivably make the return trip without using the 2 hour exception, you can not leave that terminal, because you are at a safe facility (not stranded on the side of the highway). If your FOS knows that you ran in adverse conditions on your way, and you will not have enough hours to do the return trip, he can not legally let you go.
