Man, I feel for that driver, in more ways than one.
 
I am too sure the driver is going to be charged with anything. Could be that the construction workers could be 100% at fault. This reminds me several years ago over near Orange, Va a Roadway truck got tangled up with some construction equipment in a work zone, but the driver of the Roadway truck was an ex-state trooper and knew the law. The outcome was that the truck driver sued the contractor and won and walked away with his pockets fuller than they were before.
 
Unless the trailer was taller than legal height & signs were posted warning of low clearance I don't see now the driver is at fault. The scaffold should have been at least 13' 6" above the road surface. I can sympathize with the construction workers though. I respect workers & always slow down in construction zones. There have been several highway workers killed & injured by careless drivers in this state.
