Sounds like the MOU is null and void..

No, not at all. The company did not enter into an agreement individually or collectively with its employees, it entered into an agreement with the Union which acts on behalf of the employees.

Also, Article 6, Section 1(c), "No other Employer shall be bound by the voluntary acts of another Employer when he/she may exceed the terms of this agreement".

The mou2014 has been null and void for quite some time.YRCW has breached the mou by running pts on "bid" destination runs which this particular element was not even discussed nor accepted by our members.MOU stated pts was to be used only for new accounts and overflow freght.Not to be used til the board was exhausted and not be ran because that particular Terminal was out of equipment.Yet the company continues to run PTS in this violated manner

bigtruk, there is nothing in the MOU restricting PTS to new accounts. Where do you see that? The thread with the link to the MOU is near the top of this forum.

Bigtruk, one more thing, the contract/MOU is not "null and void" just because the company violates some provision. If the company violates some part of the contract it can and should be grieved and if an employee violates some provision of the contract he/she can be disciplined. In no way does the contract become "null and void" just because either side violates some condition. How long have you been a Teamster?
 
Does everyone understand that the contract and the MOU sets MINIMUM rates. Any employer may pay over those rates, should they desire. And I did not see where YRCW was going to pay anyone more than current full agreed wages.
I got the answer strike, shut em down or get rid of the road board put all in the city and dock. Yep just keep playing games with people's lives, will close the doors before next contract they will never up there pension obligation, sad use to be a great job. Move on people XPO, Fed Ex, UPS Freight, that's the future!!!
