Why the European Court was wrong to deny FedEx sex
By David Pannick, QC
TWO WEEKS ago the European Court of Human Rights in Strasbourg rejected, by four votes to three, a complaint by a prisoner and his wife about the Home Office refusal to allow sperm to be sent out of prison for the purposes of artificial insemination. The court judgment is an indefensible restriction on human rights. The Home Secretary has no business preventing FedEx sex by a prisoner and his wife who wish to have a child.
Kirk Dickson is serving a life sentence for murder. His earliest release date is in 2009. In 2001 he married Lorraine, who had been his pen pal from 1999 when she was serving a sentence of imprisonment (since completed) in another jail. Not exactly Romeo and Juliet, but love is a “many splendored thing”.
