I supposedly am still "employed" at Greatwide/Cardinal. I had an accident May 19, and now am experiencing some MAJOR problems. I was driving when accident occurred. was transported to hospital, so injured that I was met by a Chaplin to give me last rights.
Now company is refusing to pay medical bills, my time, or authorize the tests that company's own Dr. says that I need.
It has been since May 19 with no paycheck, no Hospitalization, in great amounts of pain and discomfort, and in general as a result, a pain to live with.
Where would anyone suggest I go, got a lawyer, he is generally being ignored by the company administering comp. Have been to Tennessee burro of labor, and they are getting the same result. They filed a suit, and the court date is not until end of August. I am running out of money and patients.
HELP please, I need some useful direction.

Whenever you get hurt, get a lawyer. You may qualify for workman's comp. I cannot give out legal advice, but I can say that I have a thread here titled, "Career ending operation", check it out, as you can see my journey thru some BS as well.

There are time frame limits, so act fast, Jot down some notes about everything, and call a lawyer experienced in workman's comp claims, if he cannot help you ask him to refer you to someone who can,

Usually all first visits are free.

DO NOT WASTE ANYMORE TIME..>!!!!!!!!!!!!!

best of luck to you.

its difficult to recommend lawyers when you dont know the nature of the accident. Were you at fault ? were there injuries other then you ? what was your contract with your boss ( at will employment ) or lease operator ? you get the idea or i could go on if you want

A lawyer can advise him to pursue or drop it.

frankly, to tell him it is difficult to recommend a lawyer, is not difficult at all. any lawyer will be able to tell him what he needs to know, and refer him to yet another one that can be of some help.

would you rather he do nothing and maybe lose out on financial aid he is entitled to, under various state, local and federal laws?

No but im almost sure there are no lawyers giving free advise on this website

no, but to tell him it is difficult to recommend seeing one over not even suggesting to see one wasn't good advice from you.

just the mere mention for someone to go see a lawyer is better, then to not have said so.

You need a comp lawyer. Comp is federally mandated, state run so laws are different everywhere. If you were working you are covered, your fault or not. Here in PA we have fair comp laws, not so much in other states but a lawyer from the appropriate state will have your answers for you. Good luck to you it's ugly out there.

If you had a near similar situation, and you needed to be on comp, due to an injury on the job, the comp lawyer gets paid by (of all things) the comp insurance company, meaning NO out of pocket money from you, ever.

finally, gimme the name of that lawyer, cuz out here, lawyers get at the very minimum, $300 per hour.>!!

don't ask me how I know this......

but If your situation WAS ORT workman's comp issues, then did you still hire the lawyer.>??

If not, then in the future, don't even bother trying to get something over on your employer or anyone else for that matter.

Sometimes you gotta bite the bullet and pay the lawyer's rather than to fall prey.

Different states, different laws, I know that, but I was hurt on the job last Nov. The law in N.C. states very plainly, no matter if you are at fault or not, Workman's Comp "kicks in". I was completely at fault, what happened, I had a different truck that day and it was a Freightliner Classic which has a much smaller door opening than the truck I was used to. I jumped back in the truck after unhooking the trailer and bumped my head on the door frame. My scalp was laid open. Rescue squad was called, they transported me to the hospital and I was kept for 4 hours. To make a very long story short, I was out of work for 7 weeks, I received a check each week in the mail for $%5%% and all the medical bills were paid, no questions asked. Pure and simple. No lawyer involved. I was contracted by the insurance company that the company had their Workman's Comp insurance through. Also let me mention, the wages a person receives for Workman's Comp wages, are completely tax free, you never report the wages to the IRS, you will never receive a 1099 or a W-2.

Again, no matter who is at fault, you or whoever, if you are hurt on the job, you are entitled to Workman Comp.

this is true, my first time needed workman's comp, I did not get a lawyer. this second time being injured and a different employer, I sought out a specialist in workman's comp. the workman's' comp insurance actually pays for the lawyer. he only gets a fee upon any settlement. I wanted a layer to protect me, as in this case now, I have to go to court this afternoon, as the workman's comp insurance stopped sending me checks. I haven't the knowledge needed to fight the insurance company, my lawyer does, and as a result, this protects me.

Oh please tell me who briefed you, or do you not have to balls to back up your statement..???

Comp here comes out of the insurance payments and general attorneys fees are around $200/hour.

I think maybe where he is from (20 years to go), the lawyers probably charge enough for a tube of toothpaste for their all of one tooth to brush.
