“Both cannot be right,” the D.C. appeals court said. “Having already answered this same legal question involving the same parties and functionally the same factual record in FedEx I, we give the same answer here. The Hartford single-route FedEx drivers are independent contractors to whom the National Labor Relations Act’s protections for collective action do not apply.”

"The U.S. DOT has formally notified Congress that a required study on 2013 hours of service regs pertaining to 34-hour restarts revealed those restrictions provide no safety benefit, verifying a DOT Inspector General notice issued last week on the study’s conclusions. The DOT’s Federal Motor Carrier Safety Administration has confirmed on its website that the 2013 regs will not go back into effect, given the study’s results."

"Given the study’s results, all that remains of the 2013 hours of service rule is the 30-minute break required within the first eight hours on duty."

Yes. Make sure freight is secure. I got 3 days off from unsecured freight some years back and when I appealed it about 4 times using the 30 minute yard time and a few other excuses they always came back with you must make sure everything is safe and secure before leaving the yard.

Kicked to the curb for 3 days all because of 30 minute gate time. Son YOU are the captain of your ship and if it is not right when it rolls out the gate YOU are the one that is responsible the ticket and CSA points will be in your name not your hero Fred.

Word is the inspectors will also focus on any driver wearing headwear that may be deemed a wide load, and check for the proper permits issued by the US DOT, especially if it was crossing state lines...
