Seniority taken away by union

    Has anybody ever heard of a union brothers seniority being taken away by their BA for a bid? Been a card carrying member for over 31 years and have never seen such a blatant disregard to man's seniority, thoroughly disgusted, but maybe I'm missing something.

    If the ba losses his re-election or doesn’t want it anymore, it’s my understanding that he returns to his previous company & retains his seniority....

    This isn't the BA, this is the number five man on the seniority list, got kicked out of a warehouse, his punishment, by the union, no seniority for a bid

    I believe that is a winnable grievance. But, due to conflict of interest one would need to self represent.

    Have BA provide contractual language in reaching that decision.

    I thought the ba bumped back in, my bad. We have drivers that can’t go to certain places because the won’t show their drivers license or just plain kicked out, have him file & call above your Ba’s head....

    Something not being said, the union is supposed to defend him, not decide his punishment

    My guess is the Tm doesn’t want to re-bid the barn & they are trying to make an example out of this person....

    Amen. Agree with you 100%. We bid in April, the man has a dispute, gets kicked out last Tuesday. They decide to have a bump down bid, from his bid down. They tell him he has no rights to bid since he got kicked out of the warehouse , right now he's on the bottom 10%, with 14 years seniority

    I also saw this happen to a driver. He was able to keep his bid run and the company had to figure out how to serve that customer without using him. Had he done something to that customer serious enough to be fired, they would have fired him. His actions did not deserve termination therefore no punishment.

    Maybe they should have let the Company decide their discipline, then decide to grieve it (or not) Should he be allowed to Bump a Junior man when he already had a chance at that Bid?

    File grievance violating Article 43 of Central States Supplement.

    Never filed a grievance
    Already went above his head, called Muler, can't thank him enough for his help.

    If we bid 10 times a year, for whatever reason, seniority shall prevail
