Service Update

The beauty of the snow not withstanding, it greatly effects our ability to perform our services. We currently have limited operations at our Auburn and Portland facilities due to road conditions. We monitor it day by day and hope to restore full services as quickly as possible. Even with the effect of the snow we are running month to date at 97.99% on time delivery.

Once again when you do not have much business to start with it is not to difficult to make the gaurenteed deliveries. It is commom knowledge that the company doctors the numbers on this false statement to begin with knowing the number of deliveries that dispatch gave to drivers AFTER the appointment time, leaving the “real drivers” to smooth things over with the customers!

Holiday Schedule

We are closing on December 24 and 25 with limited operations on December 26. We are also closing January 1 with limited operations on January 2. If you need service on December 26th or January 2nd, contact your service center and we will do what we can to take care of you.
Just exactly how much more limited can you get? You are already down to about 30% of the drivers you used to have, and they were not your better drivers to start with! It seems that with your current O/R you should get all the business that you can while you can. Oh wait you can't get any business because of your poor business practices.


Holiday Wishes

From all the employees we want to wish you a Merry Christmas and a Happy New Year. We hope you enjoy your holidays with your loved ones and look forward to providing you with premier transportation services in 2009.

Even though we have kicked out our professional employees, and laid off most of our office staff, taken 10% back from all non core employees wages (except ourselves of course), and will be taking another 10% after the new year. Soon we will be nothing more than a glorified South West Delivery.
 
Oak Harbor Teamsters Update: In late September 2008, Teamsters Local 174 filed five unfair labor charges against Oak Harbor claiming Oak Harbor unlawfully threatened, intimidated and questioned employees. The Teamsters have withdrawn all but the below three issues. We believe the serious charges the Teamsters filed were proved to be false charges and were therefore withdrawn by the union. We believe the three remaining issues are minor and we took steps on October 9, 2008 to remedy all three issues. On December 31, 2008 the NLRB advised Oak Harbor Freight Lines by phone that it believed the Teamsters had presented sufficient documentation to warrant a hearing regarding the allegation that Oak Harbor violated the NLRA in three distinct situations when: 1 - Oak Harbor agreed with some of its Auburn WA employees, at their request, to have a driver committee to improve communications; 2 - Oak Harbor violated past practice in Auburn WA when it denied employees time off mid-shift on a Sunday to go to a union meeting (which was canceled by the union) and 3 – Oak Harbor violated past practice in Auburn WA when is used a different bidding method for bidding the Utility A bids in 2008. When the NLRB issues a complaint, they ARE NOT saying that Oak Harbor is guilty – it only indicates that a hearing is warranted to get to the truth of the matter. Oak Harbor denies that any one of the remaining issues violated the NLRA and will vigorously defend against the charges. Oak Harbor has 30 Terminals and charges have been made only against the Auburn Terminal. More than 3 months ago (October 9, 2008), Oak Harbor advised the Union that it (Oak Harbor) would: 1 – agree to disband the Auburn driver committee and compensate any person that was harmed as a result of the committee action 2 – agree to rebid the Auburn Utility A List as the union requested and compensate any employee who had been injured as a result of the prior bid 3 – agree to allow Auburn employees to take time off for a union meeting on Sundays as the union requested We believe the Union has now refused to accept the very remedy they originally asked for. Notwithstanding the fact that Oak Harbor has agreed in writing with what we believe are the Union’s original demands in the original filing the Union persists in its strike against Oak Harbor and its demand for additional processing of its charges by the NLRB. Oak Harbor anticipates that the 19th Region of the NLRB will issue a complaint the week of January 5 2009 citing the above three issues in the Auburn Terminal as potentially violating the NLRA and that a hearing will be scheduled. Oak Harbor expects to be fully vindicated at the hearing when that occurs. Oak Harbor continues its effort in Mediation to bargain in good faith with the Teamsters in an attempt to achieve a new labor agreement.
 
The charges mentioned here are just the tip of the iceberg, the real serious charge which I believe has the most merit is "Surface Bargaining" to my knowledge that charge has not been withdrawn. The VP's are not above the law, although the certainly seem to think they are. It is my belief that if the NLRB does an honest investigation into the way these negotiations have progressed they will have no choice but to find in favor of the union.

Is that what they call requesting a meeting with the medeator, being offered a healthcare package cheaper than their own p.o.c. plan, and walking out with out even looking at it? I wonder how much the vp's would make off of the company health care plan any way?
That is the ONLY reason they could possibly have not to at least look at the union's healthcare proposal.
I am getting compleatly fed up with joak harbor's constant b/s/ lies! Do they even know how to tell the truth any more? They lie to their customers, employees union, non union, and **** alike. Is there no end to the vp's crock of &*%$?

I been following oaks story for sometime now and all i can say it stay strong brothers because their trying to break you.I been a teamster for 29 years and spent plenty of time on picket lines so i know what you and your and family's are going through.As a road steward for big R here in the northeast all i can say is you have all of our support.Keep up the great work and one way or another you guys will prevail!Oh by the way..i love your You Tube videos!
 
How can this company ever be successful when you have 1 business(The Union) fighting against the other business(The Company). It just does not work in todays environment. Without the company, the union folks do not have jobs. Without the Union, the company would flourish. Folks that work together, stay together. Enough said.

:chairshot: Mr steeler, The Company would flourish???? And so it is ok for these Big Company hot shots to get their million $ bonuses while we work for next to nothing? The VPs at least are smart enough to build other companies and hide the money that way. But they are making tons of $ and so there is a Union to get the working Men and women a fair and just compansation for their work. It would be nice if the big money makers would see who got them there and pay them for it like the guy that sold his bearing company and split the money with the employees. YOU WILL NEVER SEE THAT FROM DAVE AND ED "NEVER"!!!!!

(January 9, 2009) Note: This update corrects the inaccurate statements recently posted by Oak Harbor on its Website (on or about January 5, 2009) with respect to ongoing Strike developments.

The National Labor Relations Board has determined that several Unfair Labor Practice (ULP) charges filed by the Teamsters against Oak Harbor Freight Lines have merit. The Board has communicated its intention to prosecute these charges by issuing a formal Complaint against Oak Harbor by the end of the month.

The Complaint is the equivalent of an "indictment" or a statement of charges against Oak Harbor Freight Lines for multiple violations of federal labor law. The Labor Board will only issue a Complaint when, after extensive investigation and review, it determines that ULP charges have merit and are supported by credible evidence. The Complaint will also contain a "Notice of Hearing" setting a date for a formal trial. At trial, Oak Harbor and its attorney(s) will have to defend against the charges. The Complaint is expected to seek relief in the form of a determination of wrongdoing, a notice posting, and reinstatement, upon application, of all striking workers.

As a result of this development, Oak Harbor has issued a statement that attempts to minimize what is clearly a victory for striking employees and their Union. In addition, the Company's account makes several inaccurate statements that require correction. First, the Teamsters did not withdraw any charges because they "were proved to be false." Second, the impact of the case is not confined to the Auburn, WA terminal. Finally, Oak Harbor has clearly not bargained "in good faith" with the Teamsters; in fact, a charge of bad faith bargaining is one of the ULPs currently under investigation. We believe that the Labor Board will find merit to the bad-faith bargaining charge in the near future as well.

We hope that Oak Harbor's "Update" will not further mislead its employees, its customers, and the public at large. Once the Labor Board issues the Complaint, we will make the document widely

The mighty Oak is being systematicly taken apart. First take out the major accounts (done) Then take out the Texas replacement workers (done) Then say good bye to security. (done) Then get the NLRB to rule in the Unions favor (done) Then get the companies $$$ to dry up (done) Then get everybody to take a 10% pay cut. (done) Get well over half of OHFL's trucks to set idle and move no freight. (done) Get California employees laid off (done) Go after Key Bank until the give the boot to OHFL. Well we arrived either before the VP Bros at the customers or shortly after to update them on the actual facts. The VP's have never understood the customers loyalty was with the Drivers not the name on the truck.

Most of us prefer the personal touch as these are people we have developed a friendship with and actually go visit and talk with our old friends.
Anything that gets the message out to as many people as possible should be just fine.

We have made it through the snow of December and the flooding of January and are back to full service as of Monday 1/12/09. We are proud of our team's determination and skill that allowed us to get through this and even provide service to a customer involving hospitals when their current carrier could not get the job done. Again, there are no weather related bottlenecks in our system. Service should be just as you have come to expect.


Full service meaning the approximately 30% since the UNFAIR LABOR DISPUTE started against us. We sent what few drivers we have out in the unsafe weather to destinations other companies were smart enough not to for safety reasons. Even though pretty much all of the customers were closed in during the snow storm that buried Portland. You should start seeing our inexperienced route drivers sitting around idle, or sleeping once again.


General Rate Increase

Oak Harbor
will be implementing a 5.9% general rate increase on all class minimum charges and LTL rates, which will be effective on Monday, January 19, 2009. Some restructuring to meet business needs will also be done. Oak Harbor's pick-up minimum will increase to $77.00 and individually negotiated floor minimum charges will be increased by $2.00 on direct points and $3.00 on indirect points.

The OAKH 500 (1-19-09 level) rates will be available for download from our website no later than Thursday, January 15, 2009. We encourage you to take advantage of this service by downloading our new rate level.

Because of our poor business sense, and unwillingness to bargain in good faith with the union, we are raising our rates to make up for some of the lost revenue. The claims, wasted fuel, wasted time, 92.5% discounts, and inexperienced employees are just costing too much. (our best team ever is costing us a lot)!

One of the DOT measures of safety is reportable accidents per million miles. For 2008 our final ratio was .05. This is as good or better as we have performed in the last 10 years. This measurement highlights our dedication to the safety of our people, your freight and the motoring public.

Once again we used factitious numbers, using only the number that we wished to use, but it was simpler since there were a lot fewer drivers, and a lot fewer miles driven (it was kind of hard for them to crash when they were either sleeping, or sitting around instead of working)! Youtube videos are the REAL example of our dedication to your freight, and motoring public.
