    Within minutes of the confirmation of the news that Supreme Court Justice Antonin Scalia had died, influential conservatives were laying down the notion that President Obama shouldn't be allowed to nominate a replacement.

    Presidential candidate and Texas senator Ted Cruz led the charge:


    "Justice Scalia was an American hero. We owe it to him, & the Nation, for the Senate to ensure that the next President names his replacement."

    Senate must simply refuse to appoint anybody. Would be outrageous to replace a giant like Scalia with a minnow like Sotomayor.

    The dynamics of the presidential race make it likely that the other Republican contenders will have to follow Cruz's lead, and with the GOP presidential field unanimously opposed to allowing Obama to fill the vacancy it will be difficult for Senate Republicans to defy them. The small number of Republicans representing blue states may break from the pack, but pressure on the leadership to block confirmation will be intense.

    Many of George W Bush's nominations to various courts were held up for years by the then Democrat controlled Senate. Turn-about is fair play, whether the gut-less RINO's in Senate will grow a set, is the question.

    Who ever sits in that seat gets to nominate anyway no telling if they will pass. But there was talk Obama wanted to be a supreme court judge.
    If I was him I want to be free for a long long time

    The two Barry already appointed have done enough damage
    Barry can nominate anyone he likes
    the senate does not have to confirm them and they should not

    In addition if the status quo is maintained and Hilly or Bernie win, I cant see Barry getting confirmed.

    Lifetime non elected appointments should not be allowed,no matter who makes the appointment(anointment).

    I was explaining the importance of Scalia's death to my family last night. They had no idea how much the decisions of SCOTUS impacts or society. Regardless of who Obama nominates, it needs to be delayed and fought against until the death. Because with one more Liberal on the Supreme Court, our society will never be able to recover from the damage that has already been done.
    But as earlier stated......does the Republican leadership have the stones to fight and delay it?

    You've got that right. Some of them are so old that they have no connection to reality any longer. There should never be another lifetime appointment. Put in an age limit and a term limit.
    Does anyone think that Ruthie has any clue what's going on? They tell her what to vote. She's not even sure if she's filled her diaper or not, yet she's making societal decisions. WTH?

    This is the one question that the Trumpster actually answered without hesitation. Yes he can, yes he will, Trumpster would do it too and congress should hold it up (not uphold it).

    Republicans had a golden oppertunity to toss this pos president out at the last election, but as we all know too many choose to stay home because Romney was not 'perfect'. This dire situation our country is as much fault of those non-voters as anything else. A confirmation vote be delayed,or the Senate can vote down a nominee. The question is, when the Senate goes into 'recess' in Jan., And a confirmation process is ongoing, can a President use the 'recess appointment' provision to fill the spot? Constitutional scholars would be the ones to consult on this issue. We all know the current occupant of the White House is not one.

    The biggest problem with the supreme court is the fact that it is politicized...... À supreme court judge should be politically neutral...... However, the fact that it has been reduced to just a mere political tool, underscores the importance of it not being completely "conservative" or "liberal". However, being as it is, it should be as close as possible in make up so as to be as close as possible to being " neutral", under the circumstances, to maintain a check and balance to the system.....even if it's a weak one...

    Any damage already done is because of the politicization of the court.....
