I have a real question for TeamIBT. What happens if a company will not agree to any union "requests" during negotiations? How long can it generaly take if the company is anti-union. How does the mediator thing work? Does either side have to use the mediator if they don't want to?
Generally after a NLRB election the government rules are the union and the company have one year to negotiate a contract. After that one year the company could go and ask the employees to vote the union out. Now if the company willfully drags the negotiations on (as they usually do) then the union has means to pressure the company to negotiate in good faith. If they come to an impass then a federal mediator will come to play and then things will more likely get moving.
ABF points to three amendments to the NMFA which grant significant wage and benefit concessions to the YRC Companies. ABF asserts that by conducting exclusive negotiations and amending the NMFA to benefit only the YRC Companies, the named parties have violated the NMFA. The amendments violate provisions of the NMFA that create a single bargaining unit consisting of all employers and employees covered by the NMFA, and that prohibit other individual or collective contracts. The amendments also tilt the industry playing field, put ABF at a competitive disadvantage, and thereby threaten its business and, ultimately, the job security of its own employees.
Doesn't look like the union created much of a level playing field....
