    Just wondering if during a roadside inspection if the inspector can request to pop the seal and check hazmat load securement? Its a CSA violation so I was just curious. And who gets the points, in the scenario, that you can be fined. The company or driver?

    But then again if it is up in the nose, and the trailer is built right, he wouldnt be able to get to it, but what if they can?


    Running into communist-fornia every night makes me want to dot all I's. Ive had 3 level 2 inspections in the last month or so.

    Yes they can open the trailer up. Don't quote me but I believe the violation hits the driver and the company.

    There is no excuse now. We have plenty of straps. Load it and strap it to the wall. TX will pop the seal. If they cant see it, then it's not a problem. Obviously.

    I know some drivers pop the seal before they leave. Can't blame them.

    thats why Im asking, just trying to CYM really. Ive seen how some guys load hazmat in FAC ops, so it had me a little concerned.

    In my opinion, if it is a sealed trailer, the person who loaded it and the FOS should get a whipping if it is a violation. I understand that the law says they cite the driver on a roadside, but that should not be reflected towards him if he didn't load the trailer, or can't inspect the loading before he takes the trailer. And that goes for all hazmat, placarded or not. I have seen some really stupid loading practices with regards to hazmat that violate almost all of our policies towards hazmat and it seems nothing is ever done about it because there was no 'incident'. The more you leave non-incidents uncorrected, the more likely you are to have a major incident.

    Well I went through this recently. Pulled a pure placarded load from 3 fac's away. Once unloaded, one of the tops of a five gallon can of paint opened a bit, technically a spill. I got the LOI for it. I was told that I can't break the seal on a trailer. Funny thing is, on the appeal, I was told its my responsibility to ensure the hazmat is secure before pulling it. No if's ands or buts about it. The very next night, I had another nose loaded hazmat shipment. I backed it in and stripped the load out to the hazmat, with the FOS and FOM both telling me I was going to be fired if I didn't stop right now as I was hurting their dock production hours. I stopped, and demanded that they call the regional safety manager. They said they would call tomorrow, I demanded they call right there at 3:00am, or I would call the director of safety myself. My part of the call lasted 10 seconds." if you want to strip it out to make sure it's secure, you go right ahead. It's your responsibility if you are pulling it. They were on the call for a lot longer. If you are pulling it and there is a spill, you get the CSA violation and the LOI. Your choice if you want to push it and do what I did.

    No way I'd take that LOI..thats pure and utter BS! Id be in touch with Mr Stotlar or something. But there are alot of contradictory policies here and every level of the food chain just wants to cover their own ass
