    FMLA Question

    I run a 261-135 laydown Tue., Thur., Sat. starting @ 2300. I was off for 4 days for a Colonoscopy (Thursday), 2 of them days I took as Pd. Personal & then was on vacation for 2 more days, for a total of 6 days off. HR Dept. @ YRC put me on FMLA because I missed more than 3 days & called it a "serious health condition". Now I have missed 2 more days because I have to take a "return to work physical". There was no complications & my doctor released me back to work with no restrictions. SO, my question is, Has anybody else had to have a "return to work" physical for having a Colonoscopy done? If so, What does the "return to work" physical consist of? another Colonoscopy? According to the HR dept., any driver that misses more than 3 days for any medical issue, will be put on FMLA. Was told this was a common practice at Roadway, I came from the Yellow side & never heard of this & have taken time off before for different "medical procedures" (non injury) & never had to get a physical to return to work.

    I know this maybe hard to ask of some of the people on this board, but, would only the people who have any knowledge about this issue respond. I have not posted here in a long time because, every serious question asked here gets numerous smart as responses & goes so far off topic, I quit posting. Thanks

    I had my appendix removed 3 years ago and was on fmla the entire time I was off and when my doctor cleared me to go back to work 6 weeks later I just showed up to work without a back to work physical.

    A new DOT physical is required if you had an injury or illness that prevented you from doing your job. A colonoscopy would not qualify for that. I worked at Roadway and never heard of any policy that automatically put people on FMLA. We all have to have these things done as we age, but maybe better to just book-off for a doctor's appointment next time?

    I agree, next time I will just book off & not give the company a heads up to have someone cover my bid. The company wanders why so many employees are disgusted with the company & why YRC can't hire "good qualified" drivers anymore.

    thats why just take the time off and dont tell them anything,they dont need to know what you do on your paid time off,its none of their business. make sure to file a grievance and demand you be made whole for the past 2 days and anything more till you are put back to work.

    have you filed papers for fmla?
    if so they can only be used for the reason your dr has put down for use .
    I have fmla for arthritis and it says periodic time of 2-3 days per month as needed.
    I got hurt in march {tore my should up pulling down a door} went out on comp.when their dr told me to see a specialist and get a mri. these people at gallager basset denied my claim.
    I have been off since march with no pay .I tried to use my fmla to keep mt insurance payed up and they said I COULDNT BECAUSE ITS NOT WHAT THE DR PUT ME DOWN FOR.
    I now have put my paper work in to retire because im not fit to work and cant live with out pay or most importantly insurance.
    point is you have to apply for fmla and for a spicific reason and can only use it for that.
    somethings just not right with whats going on here.
    BTW my lawyer says dont worry "you will get your money sooner or later" yea right!!!!

    Twice I had to do back to work physicals . Once was for a smashed finger and all the doctor wanted to see was if I could grip and bend my finger . Second was after being off with a back injury . They made me do the complete physical PLUS pick up some boxes that I had never had to do before . So can they do it I would say yes . What they will do is probably up to the doctor in your case but be prepared for a full physical so if they do anything less you will be happy .

    I just dont understand how they can just put someone on fmla without them filing their own papers to get it.
    must be differant for drivers than dock.
    3 terminals and when we file for it they take a couple weeks to approve it.
    good for 480 hours out of work for ailment that dr approved.

    Unfortunately this is Gallager Basturds reputation to deny ALL claims & force you into using a subrogation agreement to keep your insurance going & starve you out & force you back to work before healed. I know, I'm a victim of these idiots, 3 herniated disc in my back thanks to bobtailing in this fine equipment. FMLA papers were NEVER filed by me, I didn't sign NO PAPERS. This is the companies new procedure & a call & complaint have been filed with U.S. Dept. of Labor Wage & Hour Division. I have had my "return to work" physical, after they stopped laughing & shaking their heads like the AFLAC duck for the reason I was there, doctor touched my stomach & told me I'm good to go, well worth the $200 & this company can't figure out why they can't make money.

    According to my paperwork, I was designated FMLA leave starting 6/19/2012 & have 12 weeks of FMLA leave for the next 12 rolling months
