This is only proposed and has been from 2002 its still has a long way to go. I don't think it will become law it cost to much and it would strain the USA commerce. The medical review board carries no rulemaking power or authority, and transportation officials have not set any timetable for consideration of any regulation related to apnea.
AE is up to something with this. Must be a law suite and they are covering their rear end. I would say that legally that can't do this.
