Default No Overtime Pay??

Is it possible for a trucking company to not pay overtime in one state because as they say they are registered in another state that does not have any overtime laws.

I thought overtime was a fed thing.??

Anyone have any legal advice or can point me to some online info regarding OT.

Hello from Chicago ,
This has been covered before .Way back when , I think the year was 1934 there was a fair standards act passed in Congress of something like that saying that transportation workers(truckers) are exempt from OT laws .I'm sure that someone will come up with the exact info .

I always thought it was a FEDERAL thing that trucking co.were exempt. Don't know exactly how the state thing would work in. MAYBE and I emphsise MAYBE, IF the carrier, no forget it. Sorry for the vague info. Somebody post some FACTS on this.I clicked on the teamster link above,but did not see anything pertaining to this,I did a quick glance,so something may be there

from my experience as a road steward we had a case involving this issue and the ruling that came down was If you are a road driver paid mileage in anypart of your trip then no you do not get overtime pay.If you are strictly hourly rate then your overtime starts when ever it is set up in your company.some companys pay after 8 hrs,some pay after 10 hours,some pay after 40 hours,ETC,ETC,ETC.Say you leave point A and are paid mileage rate to point B and when you arrive at point B you go on the clock until you start your trip either back to point A or where ever..I don't know of any drivers getting both and winding up with overtime.If you do then you are working way too many hours and you better hope DOT doesn't check logs. Another thing that seems to be happining nowadays is when drivers are put into combonation paying runs like this and say they get into an accident and some smart lawyer gets involved and pulls pay records you wind up really getting screwed.
