A federal appeals court has delayed implementation of its ruling striking down parts of the federal hours of service rule for 90 days — less than half of what had been requested by American Trucking Associations and the Federal Motor Carrier Safety Administration.
“The clerk is directed to withhold issuance of the mandate in these consolidated cases for 90 days, until Dec. 27,” according to the issued by Judges Karen Henderson and Merrick Garland, writing Friday for the U.S. Court of Appeals for the District of Columbia.

Default 90 days and countin'

I had wrote the editor a letter on this issue a few weeks back and they published it.Folks don't hesitate to write it may not make any difference but at least your views will be read by somebody.. I wrote the editor yesterday although I am not near as well versed as most here,,maybe it will be published as the last and maybe not.But here it is..

This hours of Service issue is really quite funny.I cannot believe the ATA claims returning to 10 hours with no restart would rquire months of preparation,( what are these guy's drinking?? )..I don't recall having all this time to convert over to the new rules.And claiming our law enforcement has to have time to prepare is crazy,just how how stupid are our cops?? For Christs sake it is one hour less and we all have to keep an 7 or 8 day recap,, my gosh is that so hard to understand..I for one am happy the court chose to go with 90 day, although the ATA and the FMSCA should be happy I were not a judge.I believe after the FMSCA took so long to make contact I would have thrown thier appeal out faster than yesterday's trash.And as far as the ATA I would have treated them the same as they were a little tardy on thier request.
This whole issue is about greed on the part of the big carriers wanting more out of a driver with-out actually paying more per-mile to them,and saying in effect you work more you make more while they have more freight hauled for the same costs in labor thus making more profit.And firthermore these current rules make it so much easier for the cheaters to cheatthan what we had previously,now all one has to do is back up the book and magically have 70 to truck all over.At least before there was check and balance it was called the recap and one might back up the book, but darn it you could trim so much and gain a few hours,,now it is almost as easy as buying a new logbook..But no matter what the cheaters will always cheat and the honest will make do no matter how this plays out.I just hope the cheaters go back to having a harder time in doing so and that in itself will make our highways a little safer..
