Unhappy Lane Change Citation - suggestions??

Hi any suggestions about what to do would be great... got a illegal lane change citation, used my blinkers checked my mirrors, an SUV in left lane but was a long ways back, plenty of time to switch lanes, so i switched into left lane, then i see in my rear-view the SUV flips over. i pulled over, called 911. She was ok, only bruises, thankfully. was a 17-year old girl, a witness said she was speeding and she pulled to the left when i switched lanes then she overcorrected and flipped the vehicle three times.

I got a lane change citation, i REALLY don't want this on my record, especially when i don't think i did anything wrong. I hear the truck driver always gets the blame tho. I'm always a careful driver, got ran over by a dolly last year, by my old team partner. Has anyone ever fought somethin like this, i'm willing to pay a lawyer good to get the citation of my record. what kind of lawyer should i use, anyone know someone good in Oregon? appreciate any help

Man that is a tough one. All I can suggest is to get a lawyer. I cannot believe that with all the testimony from eye-witnesses at the scene that the officer still wrote you a ticket. Are there lane restrictions for Commercial vehicles where the accident occured? If so this my have been the reason why. I would contest the ticket and get a lawyer and have your day in court. other wise your insurance co. is going to have to pay for the other drivers stupidity. and unfortunately they do one of two things 1.) raise your premiums or 2.) cancel you all together. not a good situation to be sure.

If you did take caution in changing lanes, such as blinkers.mirrors, etc, and you have the witness names to testify she was speeding, I get a lawyer and fight it. Even the officer would have to testify as to how he concluded you made a bad lane change when he had a witness that stated she was speeding. but there are always unanswered questions, where a lawyer would be helpfull. good luck.

Call coast to coast legal plan they will charge you about 230.00 bucks to hire a lawyer on your behalf. You can locate their number in Truckers news, and Roadstar also the Trucker newspaper may have their add. I used them and was able to get a 71 mph speeding ticket in Ohio knocked down to a no points equipment violation. It cost another $210.00 bucks to the court but no mark against my cdl. (Bear in the air got me just north of Cincinatti).

We happen to have a lawyer as a member here. His user name is Opie
He is involved with a lot fo trucking related law proplems.

He also has a web site TAYLOR & ASSOCIATES, LTD | TRUCKERS STAA TRUTH IN LEASING REFUSAL TO DRIVE | DISCRIMINATION EEOC OSHA

Maybe you can email him and ask. It can't hurt and it doesn't cost a thing to email.

I got one years ago when a Pa State trooper rear ended me at night with no lights at all on. I think the other trooper was just trying to protect his buddy.. I got a lawyer and took it to court and the charges were dropped because the judge decided that there wasn't anything I could do about the vehicles actions behind me..Now granted this was a long time ago and that was before the CDL so do yourself a favor and hire a lawyer. If it happened the way you say then you should have no problem getting a lawyer to take the case.
