Default Are You Log'n OFF DUTY on delay time?

I worked for USF awhile back and they asked me, WHY ARE YOU RUNNING OUT OF HOURS? Needless to say, I didn't last long. I know some of the NON UNION carriers expect this but, witch one's???

It seems to me that "off duty" is time that I'm not working or time that I can freely do what I want (legally, that is). As such, if I'm on delay time, I log as "on duty/not driving." Hope this helps.

The only way I ever went off duty was for my convience not the companys. I knew guys who logged 15 min off duty status all the time just to be able to run more than the next guy.We had a guy at Red Star that logged everything other than driving as off duty.He was brought up on charges of breaking down working conditions towards his fellow workers and nothing was ever done about it.He was told not to do it and he did it anyway. Thats right ...It all comes down to ME-ME-Me..and screw the rest because I got mine.

I agree, the DOT regs state that off duty is defined as time that you are not responsible for your vehicle, and are not on call, or subject to be called on duty. If you follow this to the letter, all time at the terminals would be on-duty not driving.

from the way I understand if you clock in at 5am then log off duty for 2 hours your 14 hour clock still runs, your out of hours at 1900 regardless of how much time you log off duty.

Or are you talkng about somthing different?

Yep, you are right, but a lot of guys are logging off duty, when they are told to show up at say 8 a.m., but don't get their bills until 10 a.m. This ensures that they will not run out of hours on their run. Many also log off duty as soon as they get into the next terminal, although they will have to go to bed after the 14 hours, they will have more hours left to run that week, under the 70 hour rule.
