Default On the job Injury

how long is sufficient time to have to wait on a workmans comp claim, after all the doc reports are in the company "hands" to wait before you know you are getting screwed by your company?

Thats a good question, I have only had one w/c, it was for 2 weeks so I got no static, I have heard of guys really going through the ringer though.
One guy from Fedex freight out of Clinton OK b-4 they moved them to Enid or Lawton, swears up and down that w/c people broke into his house, I know this man and I tend to believe him. Good luck brother!!

first and foremost.....keep and make a paper trail...........

next, it does take time for the company to communicate with the insurance company. now i'm not saying they can't communicate via web or phone or fax, i mean the overall communications required. in many states you are NOT REQUIRED to see the company workman's comp doctor or clinic, or hospital, or emergency room........be aware of that too, and check it out.......the company (employer) doesn't want any lawsuits, so never mention that, however, for your sake, seek legal counsel ASAP and hand over any paper trail you have started..........

your company may screw with you...

your company may deny your rights

your co's insurance may deny your claim

your employer MAY fire you

your employer MAY consider you as damaged goods, and are fireable...........

this is why you need "back-up" in the form of a worker's comp lawyer (just in case)........

your company MAY require you to re-take another DOT physical, maybe at YOUR expense, or they pay...........

your company may deny you your job back


in today's economic failings, to be rid of an injured worker is real easy, and it cuts their overall cost...........they won't even flinch an eye at any lawsuits..........

Remember that the first three rules of insurance companies is "deny the claim, deny the claim, deny the claim." Fourth rule is "starve them out."

well, my company is self-insured and they have all of my records. I had no previous injury to the shoulder. I did everything by the book. I am going to talk to a lawyer though but they already said that I should probably start looking for a new job but I can't even talk to anyone else until I get this shoulder fixed, I can't shift and I am not going automatic LOL

too bad you don't have that conversation on tape....it would hang the employer......

talk to a lawyer specializing in worker's comp laws in your state.......

get your injury taken care of first and foremost. when you are able to return to work, be prepared to have a doctor's note clearing you to return to work. you will most certainly be required to take a new DOT physical. any new employer "may" shy away from you since you were hurt and cost your (soon to be) former employer some money. however, i think it would be next to impossible for no one to ever hire you. your work record, your driving record, should help you get another job.
