I remember the story. He won the workman's comp injury case on the grounds that he was driving on the correct route, etc., when he was hit by a train. He and his co-driver were engaging in a sexual act at the time of the accident. I recall that she was killed. I do not recall when this happened. The problem searching for old cases on the Internet is that the case happened before newspapers went on line. At least, I testify that this story was in the newspapers at that time.

I think this is what your looking for....Comp ruling tests limit of 'horseplay.' (workers compensation case) | Article from Business Insurance | HighBeam Research

Anytime you need to find past info on the net. Just go to Google and click on news and click the dates you think the event took place and type as much info about the situation as you know.... make sure you click on the dates on the left side of the column.. or you wont find it.

There must be another thread on this subject. I posted the answer in that thread after finding it on Google. The case in question is Darco Transportation vs. Dulen.
