Default D.O.T. drug test Failure

Friend asked me what the law was on failing a test. Is there a loss of license, suspension of license, any fines? I coundn't find anything about any of those.

I think depending where your from it stays posted for a couple of years. For a back ground check. When you are looking for a new job. Just like they can find out about you having a DUI. Thats why on apps. You see it say have you failed a drug text in the past 3 years.

if its a random i believe it gets put onto your DAC.. i have gotten a copy of my DAC some time ago, and on a seperate page it does mention drug testing and alcohol too...

below that, it lists the companies i had a drug screen. (pre-employment)

now however, if a pre-employment drug screen was a failure, they shouldn't hire the guy to begin with.....i don't know however if they would still "DAC" him since he filled out the application........but wan't subsequently hired.

so i would "surmise" that once employed, its on the DAC file...

if its random, its going to be on DAC file..

i think loss of license or suspension would be if he was under court ordered drug screening to maintain his probation...???

or, if he tested positive after an accident, and he was charged...??? (as a CDL driver, in a CDL vehicle)

but other than that, he shouldn't lose his license or face any fines if pre-employment, not even random.....but he will lose his job, and be "DAC'd"........

well this i am NOT 100% certain....

i'm thinking if its pre-employment, and the guy fails, he doesn't get the job.....if the company is doing things right that is...

NOW, some companies MIGHT DAC him solely because he did fill out an application, because it might be thier company policy, but i think that would be disputable because he didn't actually get hired.....

but in all reality, failed pre-employment, no job, no DAC....

failed random.................now we are talking DAC-able offense, and job loss....

why doesnt a driver study for his drug test he knows it can happen anytime and when it does happen dont cry the blues because you got fired for it. im a product of the 70's i grew up quit smoking the pot and yes i did inhale.but again its time to grow up!!
