We had a tough time getting our BA let alone the steward to enforce this.....

Section 6. Overtime
On a weekly basis, the Employer shall be permitted to work the active seniority board 25%
of the straight time hours in overtime. In the event the Employer exceeds the 25%
overtime allowance, the number of overtime hours in excess of the allowance will be
applied in the next following week for determining the number of employees to recall from
lay-off.
For example, if the Employer has 120 employees on the seniority board with 100 actively
working and 20 laid-off, the Employer shall be permitted 4000 hours straight time hours
plus 1000 hours overtime (25% of 4000) for a total of 5000 hours to be worked that week by
the active seniority board. If during that week, the Employer actually worked the 100
active employees a total of 5600 hours, there would be 600 hours in excess of the 25%
overtime allowance. The 600 hours would be divided by 50 (40 straight time hours plus
25% of 40 or 10) which equals 12 employees to be recalled from lay-off in the week
following the violation of the 25% overtime allowance.

In my opinion...Good luck in trying to get this enforced.... there was way to many greed people to allow this to happen. Screw the junior man!!!

We have been watching this in JO for awhile. We filed on this many times and supposedly we are to be back paid our self payments for benefits. We are holding our local to this and we get the numbers checked weekly. I will believe it when the $$$ is back in my bank.

jodock, You are due all wages you are due, plus all health and welfare payments and credits due. I personally didn't wait for the BA to approve or the hall. We filed on each infraction individually and walked each grievance through the process, and yes with some stalling and frustrations but in the end all grievances were heard on and dealt with and every penny owed was paid 2 weeks ago. As i said before any one knowong a DS driver or seeing one, road or city, knows Boomer and they all have my phone # which i answer 24 hrs a day for the drivers. I will be glad to answer any questions.

It is my understanding that our local BA in JO is crunching the numbers because of the grievance being won by the Int'l. I just am waiting along with a few others for the refund. Who knows when that will be. But thanks, if we get stalled much longer, we will give you a call.

In LO we won but the local told us that YRCW didn't have the money to pay us? That didn't help the guys on layoff pay their bills much.

Benny, This is unacceptable on the Locals part or the BA's. Your receiving some bad info because of someones lack of backbone.
I filed on each occurance on every Monday following the Friday counting of OT for the week. I filed for each driver individually. Lots of paperwork and patience but well worth it.
The IBT did not win any grievances, but formed several sub-committees and extended the waiting time to settle these. The local stewards and cooperating BA's saw these through the process.
YRCW had the money to pay all ours and the checks all cleared, so if your BA or stewards are accepting the no money excuse they should read this. Boomer
