4 yrs with RDWY, bout 13 yrs total driving and not so much as a speeding ticket, now they are going to charge me with a preventable accident. Here's the info.
First off i'm P&D, made a delivery to a local church, and when I was leaving I caught a power line from the pole to the bldg with the tlr. I'm not an electrician so I'll try and explain best i can. It pulled the power line from the mount on the bldg, and shifted some pvc that went from the line leading into the breaker box.
I thought Good for me!, the man at the church just retired from the power company (and a Union Brother). As was the man that was coming out to remove the downed line from my tlr. And he told me they've had big trucks threw there before with no problems. Then he started pointing out a few thing's too me.
The pole this line was running off of was recently replaced. It was fitted with three transformers, weighing he said, about 1200lb each, and that it was not anchored. He also said that the pole was not set properly when installed and it was visibly leaning. So I started taking alot of pics with my cellphone. I was given one more tidbit of info by my brothers(thx again), and when the company enginier showed up on scene, all I said was...What's the minimum drop for that line? She paused, then said 16 1/2 feet. My next question was "well, can you tell me how my 13'6 tlr caught it? And she could not. I can cuz the freaking pole is leaning! To boot the church's electrician showd up and said that lead on the bldg was mounted at about 17'.
GREAT NEWS! before all was said and done, the power co accepted all responsibility for the damages. Which to property meant nothing more than remounting the lead to the bldg.
Ohhhhh but waite! I'm going to get hit for a prevntable, according to the co. because it happened on private property. Of course I'm protesting, didn't sign my letter yesterday, and get a certified one today. lol. For one thing the letter states that I caused 500 dollars damage. er' to whom? I went out of my way to protect TDWY and point out that the power co was at fault. And they accepted fault. RDWY is not out one red cent! And when I asked the TM where he came up with the 500, if he had spoken to the power co, he said no, "I just have to put an ammount in the letter", oh, ok and I'm supposed to sign it in agreement? me>

What really pizzes me off is that I did what I thought was right to limit or exclude any responsibility on the part of RDWY and now I'm getting thrown under the bus. We'll see how far they wanna go, cause I also told him if I was gonna get a preventable, the first thing I'm gonna do is call that engineer back and take responsibility for this mess and give them info on where to send the bill. I'm sure the power co would be more that happy to put thier screw up off on someone else and let them pay. Just like YRCW would. I aint signing S**T!
