Default Railroad Act ?

At our local union meeting it was reported to the members that the local's attempt at organizing the Fed EX barns in our area had come to a dead end due to the Railroad Act.

It was the opinion of the local that all Fed Ex organizing would have to be coordinated on a national level through the IBT.And it appears that right now the IBT is too busy with UPSF & the organizing of Fed Ex will have to wait.

Does anyone know anything about how this Railroad Act puts the Teamsters at a disadvantage when they try to organize Fed Ex barns ?

Thanks brutus/hbf... With my attention span & ability to retain information it will take me a month just to read throught this act.

I should have asked the BA how it hurt organizing on the local level.

I had hoped that someone on the boards could remember why the courts had ruled in Fed Ex's favor on the issue of union organizing.

My question is this; if UPS had not signed the neutrality agreement with the IBT, would the Railroad Act require each UPSF barn to be organized seperately like Fed Ex ?

Back in 1997 I attempted to organize some FedEx Centers in the Atlanta area. Things were going good in our area, and others too were doing the same.

THEN...... FedEx got there friends in Washington to add to an airport bill that FedEx employees would come under the Railroad Act (So much for the Democrats being the "working man's party!).....So thank you Ted Kennedy for pushing it, and Clinton for signing it! The Airport bill listed MANY support clauses for funds in many areas, so those in Washington would pass it, so the FedEx part of the bill did not mean anything to them.

I have organized under the Railroad Act before....it just means that the IBT would have to lanuch a NATIONWIDE campiagn for 1 vote on going union. It would be a mail ballot where you would vote at home and mail it it in.....but i doubt the IBT could afford a campaign of this magnatude at this time............KK
