A motorist sued for a fatal tractor-trailer accident can't withhold his medical records from experts hired by the victim's employer, the state Court of Appeals ruled Tuesday.
But Mickey Joe Hayes also doesn't have to answer questions from
Roadway Express about whether he was taking a certain prescription drug or drinking alcohol before his Ford Taurus collided with a company truck driven by
Mark Joseph Horn on March 7, 2004, in Surry County. Horn was killed when the truck cab detached from the trailer and fell off a bridge.
Roadway and Horn's widow sued Hayes and Inzone, a Kernersville nightclub and sports bar, alleging that the club was negligent because it served a large amount of alcohol to Hayes before the 3:30 a.m. accident.
