Police are not required to obtain a warrant before placing GPS tracking devices outside the vehicles of potential suspects, a state appeals court ruled Thursday.
In a 4-1 ruling, the Appellate Division of state Supreme Court found it constitutional to place the devices on vehicles so long as they remain in public view.
The decision came as the mid-level court upheld the conviction of Scott Weaver of Watervliet, found guilty last May of a 2005 Christmas Eve burglary and grand larceny in Latham. He was convicted after breaking into a Kmart on Route 2, but acquitted of previously burglarizing the Latham Meat Market on Route 9. He was sentenced to 2 to 7 years in state prison by acting state Supreme Court Justice Dan Lamont but has been out on bail pending his appeal.
