I have a question for y'all. One of our drivers was driving along a few nights ago in the great state of Ohio, on a road utilized by 10 of us FedEx Freighters every night. As many of you know, Ohio is 55 mph state for trucks, and is notoriously noted for the strict enforcement of this truck speed limit. This driver was ticketed for traveling 73 mph. He was actually doing 57. A 4 wheeler was passing him when they went by the state police hiding in the bushes. His truck is a 5000 series volvo, and trust me he's lucky if he could do 65. The lay of the land was flat as a board. When he told the cop that the truck is governed, and couldn't possibly do that speed, the cop told him "yeah right, I've heard that before". This particular police officer is noted for his disdain for FedEx Freight. He's pulled over many of us. This driver is now out $400 for the lawyer, and will have drive to OH, and loose time at work to fight this. Why, because FedEx has told him that if doesn't get this ticket reduced, He is GONE!!! They will not back him. They will not have the truck put on the computer to prove he never went that speed, or provide information to OH that our trucks aren't that fast. Nothing! Just simply, Your on your own. If he was truly guilty, I'd say sorry bud, but this is not the case, I was 5 miles behind, and we stayed even, and I was doing 55/56. Does anybody else know what could be done? I know this was winded, just looking for info.

How far did he go to get FedEx to help him? Tell him to go all the way to the top if he needs to. He may can get his lawyer to subpeona the director of safety at HRO...Mention this and see if HRO will help him now.
 
inform him to sign up w/pre-paid legal and they cover also pre-existing occurences in most situations. the cost is relative inexpensive:bgroovy: :duh: it retains an attorney @ all times and is tax deductable @ years end. the trucking plan is $36.00 a month and has the top law firms in the u.s. ..great recommendation!!!!!!!!!!!they will fight the company as well if need for that occurence:duh:

I know that he spoke with safety in Harrison, as well as regional safety director, as well as officials in Ohio. Another driver from DAY told him to contact the Attorney General of Ohio. It worked for him when he was accused of driving 71. One other thing, is it true that 1 violation over 15 mph is automatic dismissal? Someone told me the handbook says 2, but I haven't checked. This is why safety in Harrison told him to get it reduced to at least 14mph or under, or else he would be terminated. I agree with y'all, he should speak to someone other than safety. Pat R if need be. If he was doing 65, then fine, give him the ticket, and that is that, but this is a total shaft. These OH cops sit on top of an on ramp, go to sleep, get woke up by their radar, and they go after the first thing they see. Hopefully he'll be successful.

I hate that we are always just get basically treated as you are guilty no matter what...I have heard about the Ohio cops how they operate and everything I probably would have been in Jail that night if it would have been me when the officer told me the obsured infraction of 73 mph.You know what else is sad these people can shaft you and get away with it.How can they go home at end of there shift and sleep knowing they lied about it or whatever.The other funny thing is they say they always need the publics and why dont the public respect them well pretty simple to me why they get no respect.Once you get shafted why would you want to turn around and help them out.
 
We recently had a driver get a ticket for 68 in a 45 zone. It was a normal 60 mph zone, but due to repaving, they took the 60 sign down. It was not marked 45.. This was in Monett Mo. He was driving a new Volvo taking it back to SGF. I haven't heard what his attorney came up with, but I know he never lost a day of work. I am sure since fedex took over, they don't give a darn about people,, just numbers... This isn't my only case,,, it is many that says numbers,,, not people.... I wish it was still AF,,,, The Garrisons cared about their people.... No More....
 
If you are a dirt bag and lazy, or a suck up then management will stick up for you. If you do your job and have a good safty record and mind your own buisness then watch out!! That is my experience at Fredex I do not know why but the lazy ect. seem to get taken care of. Any one else had this happen at their terminal?
 
Just a suggestion, pay to have the maximum speed of the tractor certified, get a statement of that and one that states it is not possible for the tractor to go as fast and the officer said he was going. Have the officer swear he is telling the truth, then introduce the statement that it is not possible to go that fast. I doubt it will happen to the officer but you at least have him in open court perjuring himself. Who knows maybe you will get good judge and assitant DA and they will at least have him censured. And let the driver off.

When you go to court details mean everything. Sounds like the officer used radar, to figure out his speed. In cases involving radar, have him find some literature the describes the way the radar beam works. If he can be accurate in describing how close the other car was to him when he was passed, and how far away the police officer was when he used his radar. When a cop shoots his radar, the beam will spread causing him to catch the speed of other vehicles. My buddy is a cop, and he's been told not to use his radar in high congestion areas because, it is less likely to hold up in court if someone really wants to dispute. Good luck! Tell him to fight it, it may work out for him!

When he spoke to company officilas did he mention that we are a "People First" organization??

there are a couple things in this post i will comment on:
1- the lawyer ain't worth nothing if he can"t deal with a traffic ticket without your buddy missing work.
2- he ain't worth nothing if he can't get in reduced.
3_unless your buddy goes to court and lies he will have to admit to speeding. 57 in a 55 IS SPEEDING like it or not.

here are a couple of tricks i have learned and used in the past. call the county prosecutor yourself see if he will reduce it or call the judge before you go to court, tell him what your up against at work then ask if he can reduce it a couple miles per hr. so it is not a SERIOUS VIOLATION on your CDL.

like the others said it's all about the money but that can work in your favor, offer to pay a bigger fine if it's reduced. that way everybody feels like they got something,he got the ticket reduced and they got there money.

just doesnt seem right let them get away with screwing you over although who has the time or resources to fight them. All you can hope is to the officer who wrote the ticket he get screwed over someday as I always say What goes around comes around!!!!
 
In california 15 MPH over is automatic loss of license. That means automatic termination. Can get reinstated only if case completely dismissed. FedEx will not help.
 
The driver in question told me Thursday night, that his lawyer will/should have this resolved, so that he doesn't have to go to court. It's really the hard fact, that they can get away with it. I ran with this driver, and we checked his speed. I have an 8000 series Volvo, where I can look at the computer and measure the speed. His foot to the floor and I stayed behind him. Max speed was 63. Unfortunately for him, he's only trying to get below the 15 mph over for FedEx, so that he doesn't get fired. He's still going to pay for something he didn't do.
 
if you have a shop go to one of the mechinics and ask him to hook the computer up to the truck and do the print out on the activity on the truck and to print out the computer settings for the truck. been in this position twice before and never even talked to saftey about getting the print out I just asked the shop. Goodluck with Ohio.
 
Have any of you guys tried that GPS program that alerts you to speed traps. looks interesting. I was thinking of trying out phantom alert. anyone with personal experience in here?
