Career Ending Operation???

it is funny how EACH TIME, we go to court, how suddenly the other lawyer can get a hold of the insurance company (his client) and the gal at the insurance company "cuts me a check".....

the judge was told of my dad being dead, and how i cannot come up with any money to buy a grave stone. he looked at the other lawyer and asked, what's the CONTINUED PROBLEM...???

the judge wanted to make a higher payment to my lawyer, then he reimburse me, but by law, he cannot share the money with a non lawyer.

the judge told my lawyer to petition the state house to amend the comp laws for higher penalties especially in cases like mine, where i seemingly tend to "fall off" the pay list every so often.....

my lawyer said that has been done in the past, but the insurance companies usually don't budge, as they have a larger lobbying force.

so in the end, i WILL be getting my check, this week hopefully, with the penalty monies attached.

on another note, the insurance company approved the MRI.

hopefully that can be done with-in a week from now, as i see the doctor on the 16th of this month.

i reminded my lawyer again, that i was a long haul driver.

i reminded him, that meant, i can go the distance

he smiled and nodded....he knows i am stead fast in this.

UPDATE: May 7,2016

well my compensation checks and penalty check arrived this morning. i was paid up to this week.

nice big checks, but since i am in a hole, they will go fast, to catch up with the bills.\


maybe now too, i can put at least a down payment on dad's grave stone....

your "advice", is unwarranted to me and many others at this time....point three............

there was NO WAY to properly move the dock plate, in relation to the trailer door, and the narrow loading dock door.......point 4

it looked very similar to this dock plate..

i have only been a driver for 28 years when this happened, i think i have an idea on how to save my back....but you were NOT THERE.

since it appears you "came in" recently, i know this means you did not read the entire thread/posts, which would have explained many things in detail, so i will cut you some slack....point 5...and end point.

I wasn't trying to correct whatever caused your injury. I was just thinking a long stick might help to place a heavy dock plate in the right spot if you ever had to do it again. I injured my back 20 years ago lifting a 25lb block of ice. It didn't take much and It hurts all the time. I just take it easy on the lifting and hope it doesn't give me any worse pain over time. It doesn't sound like your back has any more chances left. That is unfortunate. Wish you the best in your retirement.

the docking plate i had to use, had no holes to even use say a 5th wheel puller...

right now, i still have documented nerve damage, and am waiting for the MRI to take place. i still need yet another operation as well.

right now, my weight limits for lifting, are documented at 20-25 pounds, and that is on a good day, when my right leg does not go numb.

as far as i have been told, unofficially of course, is that i am done. but i still have to go thru the hoops for this next operation. the insurance company must have thought, i'd be a quick operation, quick therapy and back to work.

well, they figured as wrong as can be.

got an email from the lawyer, that finally the insurance company has ok'd the MRI.

now when it will take place?. takes up to, 2 weeks for the paperwork to make the rounds.

still getting a numb leg, and back pains. all that i have been reporting about here, for months now.

No, still in NoDak, still delivering the mail. Missing my oil patch but we all know how THAT'S been, so I will be here till something changes and I can't pass it up.

Well I ain't neva...................had a M.R.I. as I ain't able ta stay still long enuf or in such a closed space (other than a Cavern, mine shaft, sleeping bag, go figure) to get results.
I had problems with those wonderful Plastic trays (wat ya lay upon with the thin [jail type] blanket) to get C.T.s in 2001 for that Cancer treatment.

My back starts hurting when I read about your back hurting but I ain't gonna stop reading about ya or commenting to ya eh watt watt.

Drink yer :coffee1: and do what ya can and we're sending ya a :grouphug:!!

I'm 10-10 till Sunday p.m.

Keep yer chin up Mate (as it helps to see where ya be going).

@Cerberus_Kelpie .......it is sorta funny in a way, that i have had MRI's in the past, closed bore types in fact. but the last one i had, in the beginning of my insurance claim, must have been a smaller bore then previous, as i was in a panic, being in such a closed bore.

i will be having an "open MRI" this time around.

how am i feeling/doing...??

feeling like shyte, doing the pain shuffle.

some days are "just ok" others are as painful as if no operation had taken place.

Those who have never had back pain have no idea how bad it can be. Good luck and keep up the fight.
i still await my MRI..which was approved, back on the 18th of May.........!!!!!!!

if i hear nothing by Friday (June 3rd), then on Monday of next week, i will email my lawyer to find out WTF is going on......

is that you have not waited through the (and you well KNOW this) muck and mire of getting "approved".
It'll most likely require a "judge" to produce another decree stating the "insurance twits" get 'er done, then, of course, a wee bit of "cooling down" time of the "insurance twits" before initiating the final processing functions.
Expect clarification sometime near June 10 or 17 thereby completing the 30+ day cycle of approval, or so the many stories of unsatisfied clients/patients have attested.

i will be sending an email to my lawyer Monday (6/6/16) an inquiry as to why they went to court on May 18th, for the approval and here it is nearly 3 weeks later, and still no MRI appointment.

i still get my weekly checks, so in the end, they can take forever to get this done...

i draw closer to retirement each day now, as it is.
