FedEx Freight | No Charges For FedEx Driver Who Fatally Punched Man Calling Him The N-Word

Had a driver at my center terminated for leaving his company vehicle to confront a driver who had cut him off. Another person called in to the terminal with unit numbers and reported that the Fedex driver was at the drivers window of the car that cut him off. Had a pre shift about the incident and we were told if you leave your vehicle to confront anyone you will be terminated.

Well yeah, that’s just common sense, which clearly this driver lacked
 
All men are innocent until proven guilty and based on what little facts are presented in the story, Mr Warren lost all innocence when he exited the company vehicle to confront Mr Magnuson. Just because Mr Magnuson was in poor health should’ve had no bearing on the fact that Mr Warren retaliated over something so petty. This type of behavior may be ok in Oregon but in the south, Mr Warren would’ve been found guilty of involuntary man slaughter at the least.

Sticks and stones may break my bones but words will never hurt me!!

IMO, all could’ve been avoided had Mr Warren carried on and continued to do his job.

You're pretty quick to defend the ⓇⒶⒸⒾⓈⓉ who attacked this driver because of the color of his skin. It doesn't even say why he was out of the vehicle. Just the other day I was parked in the turning lane of a major highway with my flashers on because I couldn't fit into a customer's parking lot.
Perhaps he was trying to ignore this scum bag and trying to perform his duties.
You don't think this driver has the right to defend himself while being attacked by a ⓇⒶⒸⒾⓈⓉ. Maybe it's a southern thing I just don't understand. If he continued to beat the guy while on the ground you'd have a point but he hit him once in self defense.
Swamp is right. We don't know Fedex's policy when it comes to self defense or whether he still has a job.

Read the article again. Witnesses reported Fedex driver exited his vehicle to confront the name caller. No where does it say he was performing any duty other than the fact he was speeding and was yelled profanities for doing so. The point is he stopped his vehicle and was the aggressor. I call BS on the no duty retreat clause and the FedEx driver had every right to cold cock him.
 
I am fascinated by the comments but i do have one question that provides perspective: If the races were opposite and the equivalent occurred, would it be treated equally? Sadly probably not and especially not in Illinois, California, New York, and a few other areas. Equality does not exist in those places..

His job is irrelevant at this point, a man is dead because of “name calling”...really?? Shouldn’t Mr Warren have been the bigger man and continued upon his way doing his job??

I get called names, given the finger, etc by motorist on the daily, usually for holding them up for 10 secs while my slow ass truck attempts to pass another...that doesn’t give me the right to exit my truck and confront the idiots!! I continue on and at the end of the day we both return home safety. :1036316054:

I watched a DLI driver hit the shoulder of i95 in Connecticut behind a small pickup that managed to annoy him in construction.

He was screaming and tugging at the drivers door of the compact pickup really trying to get his hands on the skinny white kid driving it, until the 3 other doors swung open and the kid's three offensive lineman looking brothers climbed out.

I learned a couple things in that moment, the first was that the Tacoma wasn't lowered - it was just LOADED! The second thing was never assume you're going to teach any lessons out on the road!

The DLI driver cooled off immediately, got into his truck and drove off. None of the boys threatening him in any way. No punches were thrown.

Never questioned the fact that Mr. Warren COULD (likely) have ignored the aggressor. Probably wishes he had. But legally he had the right to respond verbally to verbal attack. Then after, and only after, the aggressor escalated to physical attack, Mr Warren responded in self defense. Both reasonable responses.

“Both reasonable responses”....this is where my comment about the south comes into play...

Most states have what is called a “reasonable person standard” meaning the DA has to ask, how would a reasonable person respond. In this case the DA, Mr Gibbs, decided that Mr Warren acted reasonable when he responded to the verbal assaults. In the south, when a verbal argument escalates to death it’s usually considered unreasonable, even in cases where the death was unintentional...such as with this case...which usually leads to charges of involuntary man slaughter.
