Career Ending Operation???

Just passing by and noticed your post. Congratulations to you, hope your life will be a little easier now.

Something I found and I think its a bit weird but I would expect them to ask for the routing number for your bank account for them to make a deposit. But they already know all of that without saying a word.

oh yeah, they (SS) can make deposits AND withdrawals from accounts if they over pay.......
 
UPDATE: April 10th, 2019

tomorrow, i go for a 7:30 AM appointment with the court ordered IME doctor.

the judge had already sent over a package from both my lawyer, and the insurance lawyer.

I will take my most recent x-rays, and the MRI and CT scan disks from 2017 (but he will have those reports as well)

to this day, even though it has only been since january for this current suregry, i still cannot stand up for more than about 20 minutes at a time.


my left foot is still numb, albeit, only half the foot is numb, like from the middle toe, all the way back to the heel, on the left half of that foot, (not the entire foot as before this surgery)

like many other homes, in your bathroom, you have to slightly lean over the sink, to wash your face, so that you can shave....when i do this and straighten up, i am reminded with pains.

when i get up off a desk chair, such as behind this computer, i am walking hunched over for several steps, before i can straighten up.

i still have not even been to the physical therapy place to hand in the slip to start p/t...

reason being, well....i want MORE healing time, and i have no need to rush this, as i am already on a percentage of SSDI and workman's comp still.

this means of course, that i am officially retired, so why rush anything from this point?

this court ordered doctor i will be seeing, is the very one since way back when the insurance doctor....Dr. NO or Dr. Denial, refused to agree that i needed more surgery or revisions.

Dr. NO, had dictated his report, and then he signed it, saying that i am totally disabled......later, he tried retracting that, and my lawyer quickly petitioned the court for this second opinion.

i said earlier that i cannot stand for very long, i also cannot walk for long distances as well, which ticks me off, cuz i have been leasing a car now for over 2 years...ok..and so..?

well, i park far away from the stores doors, as all the nitwits want to park up real close to the building, you know, like truckers do at truck stops?

well if anyone has ever leased a vehicle...guess what......YOU PAY FOR ALL DAMAGES done to that vehicle

i have already paid out $800 + car rental fee's for some ahole, that pushed a shopping cart into my front bumper, when i went to either a Lowe's or Home Depot.

no matter where you park at those places, you have runaway carts, and carriages...

cha-ching.....new front bumper, paint, and car rental...cha-ching.....

so given that i have to pay for damages, i park as far away as i can, now comes the inability to walk for very long.

in my state, NO...i cannot get a handicapped parking permit.....

why..??

i don't need a cane to walk.........i have no breathing problems.....i have no heart condition.

could i lie about the need for a handicapped parking permit..??

i suppose i could, but then it's not in me to lie about something just to get something.

if on the other hand, when i go and see my surgeon in a few weeks, if HE SAYS< that i should walk with a cane, then i will ask him to write up a script.

but otherwise......i will not push that issue.

surprise...surprise...

i showed up 30 minutes earlier for my court ordered IME, and i was told, i don't have an appointment.

so as my usual M.O., i showed the receptionist, the official letter form the workman's comp court, saying that I HAVE AN APPOINTMENT TODAY....

so anyway's, she gives it to the doctors assistant(??), and yeah, I HAVE AN APPOINTMENT TODAY.


ok, so i have to wait for him, no big deal, it ain't like i am his regular patient, that is paying him $850 for this less than a 30 minute visit...but i know too, he has to dictate his report, in his best medical opinion of me, and my situation.

we "chat a bit", and to cut the story shorter, i tell him that the insurance doctor deemed me totally disabled, and is now backtracking...

he says to me..."oh yeah, you are definitely disabled"

now, whether this means he states that in his report, i do not know. (i hope he does of course)

i will not know until later in May....

but i did voicemail and then email my lawyer telling him what this doctor said.

that's all i got for now.

You'll need a cane soon enough considering your current mobility issues (and a cane is good to help with balance issues like a walking stick/cane in mountainous terrain) and it's not likely you'll ever again be ice or roller skating or climbing mountains or scuba diving or hang gliding or running or playing hopscotch or jumping rope........

i dunno, it's my crappy luck, i'll get caught in a lie.

for instance, an ordinary person isn't going to ask me why i have a handicapped parking permit.....

but suppoise, just suppose, i am at some shopping mall, and a state worker who happens to work in the handicapped parking division that hands out that permit see's me.....and questions me about my disability.....

and suppose he/she looks up on the computer that i am supposed to be walking with a cane, and at that particular time, i am not....

would my goose be cooked then, for obtaining a disability parking permit under false pretenses..???

i went to the physical therapy place, and handed the gal there the script for p/t.

gave her my usual days that i can be there, and time of day as well.

she said that as per usual, the insurance company moron may not even take the call...i told her let me know ASAP, as i go to court in May, and i can have the lawyer petition the court on this as well for the same day.

"never give up, never give in"......

been exactly 6 years now on this injury.........and as a former long haul trucker, i can go the distance, and play that game too........

the handicapped parking permits, (in my state) are only for those with heart, lung, or walking by cane, or wheelchair.

i do not need a cane to walk, and i'd rather not fake that requirement.

and nope...never give up......
 
yeah, the lawyers assistant called the p/t place and asked for a fax of the doctors p/t script, some time after i emailed him.

in fact, i got a call from the p/t place earlier today, but no message was left on my machine. so i called them back. i told the gal at the p/t place, that given the insurance adjusters penchant for NOT taking her calls, i went ahead and emailed my lawyer, so he can petition the court for p/t at our court date in May.

timing was/is everything, as the lawyer has to send a "21 day letter" to the insurance company, for them to respond to the p/t order, or as the old saying goes....."see you in court"....

my lawyer got the court doctor's decision/opinion about my situation.
he said that i am totally disabled and will not be able to ever return to work, but he also said that i have reached MMI...

my lawyer will argue at least the MMI part...but he said the judge may accept everything this doctor says, or nothing at all, he may not seperate things.
i still have to see my doctor next month, and that'll be about 1 week before the court date!!

i had a call with my lawyer, and he explained the value of my claim, if when the time comes, i settle, or continue lifetime workman's comp.
he explained that they calculate payments for my life span, which right now, is 22 more years??? holy crap, i hope i live that long..>!!!!!!

he also said that if i take the lifetime payments, the insurance at any time, can send me to a doctor and try to get me off total disability, down to partial.
that would end the lifetime payments, and a high cash value settlement.
also as in the past, the insurance company can mess with paying me, making us go back to court, again.

so i have to wait things out right now, and go see my doctor next month.........

i finally get to see my surgeon today

yup, finally, since my operation back in january, i go see him.
i still have "some" numbness in my left foot, and once in a "blue moon", there is some numbness in the right.
right now, typing this, i am getting a tingling sensation in my left leg/foot.

i still have not yet neen to p/t....we still have to go to court, NEXT week, for the judges decision on me being totally disabled or not, at that time, the lawyer will of course, bring up the denial of p/t.

so they (the insurance company), continues to bust my balls...........but...... I DO NOT GIVE UP.

that's what they want, and they just ain't gonna get it.
 
update to above.

the surgeon said i must get into p/t, i told him of the denial from the insurance company, and that we go to court next week.

regarding that the court doctor said i have reached MMI, he said no, not right now, maybe sometime in the fall.

i now have to wait for the gal that deals with workman comp claims. she has to get approval of several back x-rays, and knowing the damned insurance company, i'll just bet it'll be another visit to the court, in a few weeks.

6 weeks ago, he had an operation to repair vericose veins.

the doctor stapled the incision shut..

one week after that, he has the staples removed.

ok, he goes back to work tomorrow (wednesday may 15th)...

what does he tell my sister sunday afternoon..??

"i feel something pinching my leg"

sis looks and sees 3 staples still in him....!!!!!

now c'mon, does he mean to tell me that nearly all this time (5 weeks after the staples were removed), he didn't feel anything sooner than a few days BEFORE he has to go to work..???

see what i'm dealing with here..???

an imbecile would be far more intelligent........don't insult the imbeciles of the world..>!!!!!!

besides, i give him all the heavy things to lift, carry, etc..'


if he gets a hernia...so be it.....

if he blows out HIS back......so be it.....

if he died right now......Thank god, almighty, there are miracles after all.....

ok, we all went to court today to have the judge either approve of the totally disability due to the court doctors findings, or deny it.

the lawyers had a "conference" before court, in which i informed my lawyer on many things, and we hashed out a few details on how this can go.

my lawyer knows i still have a few more doctor visits, p/t (which still has not been approved), more x-rays and a possible MRI as well.

the lawyers agreed (in conference) to the total disabilty (with out the judge as most likely i was told, he would indeed grant that), and they also agreed that i am not at MMI (maximum medical improvent) yet as well.


this all took away from the judge to say anything.

my lawyer again explained to me that total disability now erases any time limit on workman's comp, as when it could end now.

we talked about lifetime comp, and a cash settlement.

both have pro's and cons.

pro meaning that i can collect comp for many more years.

con meaning that the insurance company can send me to any other doctor and he see's that i can go back to work, at least light duty, and this will reduce my settlement monies (or weekly checks) considerably

so my lawyer asked if i wanted hom to send out a "feeler" on a settlement, that i can deny as well as accept, if' it's a good one.

as i was wating in the courtroom, the judge said he wants to retire in 6-7 more years......

and hoped that this would be settled before then.

i told him, "you ain;t gonna like retirement, you'll be so busy at home, you wish you were back to work"..

he said, no way...

he also said he was going to retire and sell real estate down in florida.

i said "ill meet you there".......he thought i already had a place down there...

i said, no, i'll buy a house from you....

to wit he said.........then we will continue to see each other..!!!!!
